Cit� o� ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> • No. /� /� <br /> s • • • <br /> —,- <br /> 24 . Granting the variances as to lot size and width <br /> will not be contrary to the intent of the Zoning <br /> Code or to the intent of the Comprehensive Plan. <br /> a) The lot is sewered; consequently, there will be <br /> no threat to public health occurring because of <br /> excessive crowding of private sewage disposal <br /> systems . <br /> b) One more dwelling in the already developed area <br /> will not materially increase the density of the <br /> neighborhood, as long as the present carriage <br /> house is removed first, prior to construction of <br /> the new house. This is particularly true because <br /> the lot previously contained the cabin dwelling. <br /> c) Adequate open spaces for access in case of fire <br /> will insure that there will be no increased danger <br /> i to the safety of the neighborhood. All required <br /> setbacks are met by the proposed plan. <br /> d) No impairment of morals will result from the <br /> proposed construction of the single family dwelling. <br /> e) The existence of one more dwelling in the area will <br /> not materially increase the traffic in the area. <br /> 25. Requiring Mr. Rhode to build in a location further back <br /> than proposed in 1977 would amount to a practical difficulty <br /> as it would have a deleterious effect on the property <br /> values of all concerned and because soil conditions may <br /> adversely affect the strength and durability of the dwelling. <br /> 26 . The same conditions outlined above apply to granting a <br /> variance as to the "average setback" rule, to wit: it <br /> will not be contrary to the intent of the Zoning Code <br /> or Comprehensive Plan and there will be no adverse effects <br /> on neighboring properties . <br /> 27 . The Planning Commission , after hearing testimony, <br /> recommended to the Council that Jack Rhode be granted <br /> a variance from the "average setback" requirement, which <br /> would allow him to build where proposed. <br /> 28 . Any variance for the lot should not be granted unless <br /> the carriage house is first removed. <br /> PAGE � OF I—� � <br /> � <br />
