CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 67 9 <br />A RESOLUTION <br />DENYING AN AMENDMENT <br />TO AN EXISTING CONDITIONAL USE PERMIT <br />GRANTED VIA RESOLUTION NO. 6037 PURSUANT TO <br />ORONO MUNICIPAL ZONING CODE SECTION 78-666(1) <br />FOR THE PROPERTY AT 1444 SHORELINE DRIVE <br />FILE #13-3606 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing under <br />the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City Council of <br />the City of Orono has adopted zoning regulations for the protection of the public health, safety and <br />general welfare; and <br />WHEREAS, Luke Kujawa representing Your Boat Club (hereinafter "the applicant") in <br />conjunction with then owner Browns Bay LLC (hereinafter "the prior owner") on April 19, 2013 <br />applied to the City of Orono for an amendment of the existing Conditional Use Permit (CUP) <br />granted by the City via Resolution No. 6037 on April 11, 2011 pursuant to Orono Municipal <br />Zoning Code Section 78-666(1) for the property located at 1444 Shoreline Drive within the City <br />of Orono (hereinafter "the City") and legally described as follows: <br />Attached hereto as Exhibit A (hereinafter "the Property"); and <br />WHEREAS, the Property has since been acquired by EOF Investments LLC ("the current <br />owner") which has assumed the role of property owner with relationship to the CUP amendment <br />request, Zoning File #13-3606; and <br />WHEREAS, the applicant has applied to the City of Orono for an amendment of Condition <br />3 of the aforesaid Resolution No. 6037 which states: <br />"3. No more than 20 slips may be devoted to boat club use. An amendment of this <br />conditional use permit will be required in order to exceed this number."; and <br />WHEREAS, the requested amendment would increase the number of slips allowed to be <br />devoted to boat club use to 30; and <br />WHEREAS, after due published notice and mailed notice in accordance with Minnesota <br />Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public <br />
