CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 67 9 A RESOLUTION DENYING AN AMENDMENT TO AN EXISTING CONDITIONAL USE PERMIT GRANTED VIA RESOLUTION NO. 6037 PURSUANT TO ORONO MUNICIPAL ZONING CODE SECTION 78-666(1) FOR THE PROPERTY AT 1444 SHORELINE DRIVE FILE #13-3606 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City Council of the City of Orono has adopted zoning regulations for the protection of the public health, safety and general welfare; and WHEREAS, Luke Kujawa representing Your Boat Club (hereinafter "the applicant") in conjunction with then owner Browns Bay LLC (hereinafter "the prior owner") on April 19, 2013 applied to the City of Orono for an amendment of the existing Conditional Use Permit (CUP) granted by the City via Resolution No. 6037 on April 11, 2011 pursuant to Orono Municipal Zoning Code Section 78-666(1) for the property located at 1444 Shoreline Drive within the City of Orono (hereinafter "the City") and legally described as follows: Attached hereto as Exhibit A (hereinafter "the Property"); and WHEREAS, the Property has since been acquired by EOF Investments LLC ("the current owner") which has assumed the role of property owner with relationship to the CUP amendment request, Zoning File #13-3606; and WHEREAS, the applicant has applied to the City of Orono for an amendment of Condition 3 of the aforesaid Resolution No. 6037 which states: "3. No more than 20 slips may be devoted to boat club use. An amendment of this conditional use permit will be required in order to exceed this number."; and WHEREAS, the requested amendment would increase the number of slips allowed to be devoted to boat club use to 30; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public
