City of Orono Page 2 <br /> 201 1-00005 February 7,201 1 <br /> Response: The evaluation of the cur�ent plans can not rely on 1989 survey information. The <br /> current plan must use current survey information and d�ainage palterns <br /> 4. We can eliminate the retaining wall, it was provided to give some flat area on the rip rap <br /> before the storm water entered the lake, but we could extend the pipe down to the 930 <br /> contour and eliminate the wall, but the outlet would be very close to the lake. In as much as <br /> it is an emergency overFlow, water should very seldom flow through it anyway. <br /> Response: Thank you. <br /> 5. If the Lot Surveys Topography is accurate, the low area west of the proposed home was <br /> created by grading and construction of the home on the neighboring lot 22 years ago and <br /> thus is not a wetland. I don't know how a wetland delineator could make any determination <br /> until the snow is gone and plants are growing so this would be a major delay for my client. <br /> Response:Minnehaha Creek Watershed District has jurisdiction ove�wetlands in Orono. It <br /> may be possible to meet with the District staff to make a determination without a wetland <br /> delineation. <br /> 6. I did provide an emergency overflow on the site by a swale graded toward the lake along the <br /> southwest property line on my first version of this plan but in a meeting with Orono, Mike <br /> Sharratt, my client tells me that Tom Kellog and Melanie objected to this grading and so I <br /> don't know how one would provide an onsite emergency overflow, unless the city's position <br /> on this has changed. If the driveway on the neighboring house was constructed as <br /> proposed,there should be an emergency overFlow in that direction, take a look at the Lot <br /> Surveys plan and let me know your thoughts and we could certainly verify how the driveway <br /> was built as mentioned above. <br /> Response: We understand that the preliminary overland emergency overflow grading is <br /> undesirable f�om both the builder's and city's uiewpoints It requires a/arge amount of <br /> grading within the 0-75'setback. However, the current plans must dea/with the current site <br /> conditions. <br /> 7. I would say that storage for two 100 year, back to back events, could not be provided in the <br /> small low area especially considering the 2 foot freeboard you requested and the slope <br /> needed for flow to the lake. <br /> Response:Ideally this storm event could be accommodated with installing parallel piping to <br /> the lake and/or enlarging the low area to the north. We would be willing to consider a <br /> drainage system that prouides the fo/%wing: <br /> a. No increased peak tlows to the neighboring property. <br /> b. No increased runoff volume to the neighbonng property. <br /> c. No change in the overtlow location on the neighboring property. (this�oute is <br /> currently not determined with the existing survey data) <br /> d. No impacls to the home o�ga�age at 3105 North Shore Orive. <br /> 8. I have attached pages from Orono's City Code 79-7c(2) and we can provide those items but <br /> first it would be good to decide just how we are going to address some of the problems <br /> above. <br />
