, <br /> � <br /> Sec.13.04 RIGHTS OF SLJB.TECTS OF DATA <br /> Subd. 1. Type of data. The righ[s of individual on whom the data is stored or to be stored shall be as sec forth in chis secdon. <br /> Subd.2. Information reqtared to be givea individual. An individual asked to supply private or confidendal data concecning himsetf shall <br /> be informed of: (a)the purpose and intended use of the requested data witt►in the collecring�tate agency,polidcal subdivision,or stacewide sysum; <br /> (b)whether he may refuse oY is legally required to supply the requested data:(c)any known consequence arisin3 from his supplying or refusing to supply <br /> private or confidentia!data;and(d)the idenrity of other persons or enrides authorized by sta[e or federal law ro receive s�e data. Tlus requirement shall <br /> not apply when an individual is asked to supply invesrigadve dara,pursuant to secrion 13.82,�ubdivision 5,to a law enforcement officer. <br /> The commissioner of ro�enue mav place the nodce rewired under this subdivision in the individual income rax or proaertv tax refund <br /> insttucaons instead of on those forms. <br /> Subd.3. Access to data by individual. Upon request to a responsible authoriry,an individual shall be informed whether he is the subject <br /> of stored data on individuals,and whecher ic is class�ed as public,private or confidendal. Upon his further request,an individual who is the subjecc <br /> of stored private or pubiic data on individuals shall be shown the dara wi[hout any charge to him and,if he desires,shall be informed of the content <br /> and meaning of that data. After an individual has been shown the private data and informed of iu meaning,the data aeed not be disclosed w him for <br /> six months thereafter unless a dispuu or acdon pursuanc w this secdon is pending or addidonal data on the individual has been collected or created. <br /> The responsible authoriry shall provide copies of the private or public data upon request by the individual subjecc of the dara. The responsible authoriry <br /> may require the requesdng person to pay[he accual costs of making.cerdfying,and compiling the copies. <br /> The responsible authoriry shalt compiy immediately, if possible,with any request made pursuanc cn this subdivision,or within five days of <br /> the date of the request,excluding Saturdays,Sundays and legal holidays,if immedia�e compliance is not possible. If he cannot comply with the requesc <br /> within that time,he shall so inform the individual,and may have an addidonal five days within wtuch to comply with the request,exciuding Saturdays, <br /> Sundays and legal holidays. <br /> Subd.4. Procedure when data is not accurate or complete. An individual may contest the accurdcy or compleceness of public or private <br /> data conceming himself. To exercise[his right,an individual shall nodfy in wriring[he responsible aurhoriry describing[he nature of the disagreemenG <br /> The responsible authoriry shall within 30 days either: (a)correct the data found to be inaccurate or incomplere and attempt to nodfy past recipients of <br /> inaccunte or incomplete data, including recipients named by the individual;or(b)notify the individual thac he be(ieves the data to be correct.
