State of Minnesota(City of Orono)v.Charles Lewis Henke <br /> On October 1, 2010, Defendant left a voicemail for City staff stating that he was <br /> attempting to make progress. <br /> On October 15, 2010, City staff again visited the subject property and noted that no <br /> progress had been made. <br /> On October 19, 2010, City staff inet with Defendant to discuss bringing his property into <br /> compliance with the City Code. Defendant refused to take further actions to comply with the <br /> City Code without intervention of a court. <br /> On November 9, 2010, Defendant contacted the Complainant and stated that he was <br /> making progress. During the conversation,Defendant stated that he had removed a couple of the <br /> vehicles on the property,removed scrap iron, and was attempting to sell the orange dump truck. <br /> Defendant was advised that he was not allowed to keep a Bobcat stored on the exterior of the <br /> subject property. <br /> On October 25, 2010, Orono City Attorney Soren M. Mattick mailed Defendant a letter <br /> stating that the property was not maintained in compliance with the Orono City Code and Zoning <br /> Ordinances. The letter stated that Defendant had until November 8, 2011, to conect any Code or <br /> zoning violations. <br /> On November 9,2010, Defendant contacted the Complainant and requested to keep his <br /> Bobcat/skid steer on the property. Defendant was advised that this was not possible because <br /> exterior storage of the Bobcat is a prohibited use in property zoned for residential use. <br /> On November 19, 2010, a City staff inember contacted Defendant and was advised by <br /> Defendant to not enter the property. From the road,the City staff inember was able to observe <br /> and photographically document that code violations persisted on the subject property, including <br /> exterior storage of: a vehicle topper in front of the residence near the road, a trailer, the <br /> unregistered and inoperable white Chevrolet van, the orange dump truck, the gray commercial <br /> vehicle, a trailer, a Bobcat,miscellaneous pieces of scrap wood, the inoperable boat, <br /> miscellaneous pieces of scrap metal, tarps,miscellaneous junk and debris,tires, and metal <br /> piping. <br /> On February 24, 2011, Orono City Attorney Soren M. Mattick mailed Defendant a <br /> second letter stating that the property was not maintained in compliance with the Orono City <br /> Code and Zoning Ordinances. The letter stated that Defendant had until March 11,2011, to <br /> correct any Code or zoning violations. <br /> On March 4, 2011, Defendant spoke with the Complainant regarding continuing code <br /> violations on the subject property. To remind Defendant of what had to be completed on the <br /> subject property, City stafF emailed a copy of the items to be remedied on the subject property <br /> included in the July 16, 201 O letter. <br /> 161874v1 4 <br />
