Sec.13.04 RIGHTS�F SUBJECTS OF DATA <br /> Subdivisian 1. Type of data. The rights of individual on whom the data is stored or to be stored shaA be <br /> as set forth in this section. <br /> Subd. 2. Tennessen warning. I�c= irtformed of: (a) the purpfls�and int�nded u� of the reque�ted data v�ithin the c�(Iecking <br /> gavemment�ntity {b} wkrether he may r�fuse o�+s legally required to supply the requestsd data; (c) any Icttovun <br /> c�nseque�ce arising from his suppl�ng or re�using to �ppl�r private vr cz�nfidential data� and (d} the identit}�of <br /> other persans or entities authorized by state or federal (aw to receive the data. This requirement sha11 not apply <br /> when an individual is asked to suppiy investigative data, pursuant to section 13.$2, subdivision 7, to a law <br /> enforcement officer. <br /> Suad. 3. Access to data by 1ndlvlduaL Upon request fo a responsible authority or designee,an individual <br /> shall be informed vuhether the individual is the subject of stored data on individuals, and wfiether it is classified�s <br /> public, private or confident'ral. Upon#urther request,an individua!who is thesubject ofstor.ed private or public data <br /> on individuaEs sha11 be shown the data withouf any charge and, if desired, shali be informed of i�e corriant and <br /> meafling of that data. �ft�r an individual has been shor�un the priu�e da�a an�1 iRform�d nf its meaning, the data <br /> need not be disclosed ta him for six months thereafter unless a dispute or action pursuant to this section is pending <br /> or additional data on the individual has been collected or created. The responsible authority or designee shall <br /> provide copies af the private or public data upon request by the individual subject of the data. Th� responsible <br /> authority or designee may require the requesting person to pay the actual costs of making and certifying the copies. <br /> The responsible authority or designee shall comply immediat�ely, if possible, with any request made <br /> pursuant to this subdiuision, or witi�in t�n days of tfie date of the request,excluding Saturdays, Sundays.and I�g�l <br /> ho4ida�s,if irnm�diate com�liance is-not possible. <br /> Subd, 4. Procedure when data is not accurate or complete. {a)An individual subject of th�data may <br /> contest the accuracy or completeness of public or private data. To exercise this right, an individual shal!notify in <br /> w�ting the responsible authority describing the nature of the disagreement. The respQnsible authority shall within <br /> 30 days either: {1) correct the data found to be inaccurate or incomplete and attempt to rtotify past recipients of <br /> inaccurate or incomplete data, including recipients named by the individuai; ar (2) notify the indiuidual that the <br /> authariry believes the data to be correct. Data in dispute shaiE be disclosed anty if the individuaE's statement of <br /> disagreement is ir�cludec!with the discltrsed data. <br /> The cleterminaffon of the r�spor�sible acr�t�ority may be appea4ed pursuant to the provisions of the <br /> Administrative Procedure Act �ela#ing ko contested cases. Upon receipt of an appeal by an individual, the <br /> commissioner shall, before issuing the order and notice of the contested case hearing required by chapter'[4, try <br /> to resalve the dispute through education, conference, conciliation, ar persuasian. If the parties consent, the <br /> commissioner may refer to the matfer to meclication. Follawing thsse effarts, the commissioner shall dismiss the <br /> appeaJ ar issue tk�e order ac�d not6ce of hearin9- <br /> (b} Data on individuals that have been s�ccessfully challenged by an �ndividual must be completed, <br /> corrected,or destroyed hy a gavemment entity witfiaut regarcf to the rec�uirements of section'!38.17. <br /> After completing, correcting, or destroying successfully challenged data, a government entity may retain a <br /> copy of the ca'r�missiQner af administration's order issued under chapfer 14 or, if na arder were issued,a summary <br /> of the dispute between the parties that does nat contain any partic�dars of the successfuliy challenged data. <br /> Packet Last Updated:Augusf 2015 <br /> Page 8 <br /> _ _ <br />
