/ � <br /> Sec.13.04 RIGHTSOFSUBJECTSOFDATA <br /> Subdivision 1. Type ojdata The rights of individual on whom the data is stored or to be stored shall be os set forth in this section. <br /> Subd.2. Injormation required to be given individuaL An individual asked to supply private or confrdentia!data concerning himself <br /> shal!be informed of (a)the purpose and intended use of the requested data within the collecting state agency,political subdrvision,or statewide <br /> system;(b)wheeher he may refuse or is legally required to supply the requested data;(c)arry known consequence arrsing from his supplyrng or <br /> refusing to supply private or conf dential data;and(d)the idenlity of otherpersons or entities authorized by state orfederal law to receive the data. <br /> This requirement shall not apply when ax indrvidual is asked to supp[y imestiga�ive data,pursuant to section 13.82, subdrvision 5, to a law <br /> enforcement o�cen <br /> The commissioner ofrevenue maV place the notice required under this subdrvrsion in the individual income tax or nroperty taz refund <br /> irrstructions instead of on those forms. <br /> Subd.3. Access to data by individuaL Upon reguest to a responsible authority,an rndrvidual sha/1 be informed whether he rs the subject <br /> ojstored data on individuals,and whether it is classified as public,private or confrdential. Upon his further request,an individua!who is the <br /> subject of stored private or public data on rndividuaJs shall be shown the data wi�hout arry charge ro him and,if he desires,shal!be informed of <br /> the content and meaning of that data. After an individua[has been shown the private data and info»ned of rts meaning,the data need xot be <br /> disclosed to him jor six months lhereafter unless a dispute or action pursuant to this section is pending ar additional data on the rndividual has <br /> been collected or created. The resporrsrble authority shall provide copies of the private or public data upon request by the individaal subject of <br /> the data. The responsible authoriry may require the requesting person to pay the actual costs of making,cer[�ing,and compiling the copies. <br /> • _ The responsible authoriry shall comply immediately,ifpossible,with arry request mad¢pursuant to this subdivision,or withinfrve days <br /> of the date of the request,excluding Saturdays,Sundays and legal holidays,rf immediate compliance is not possible. I,jhe cannot comply with the <br /> request within that time,he shall so inform the individual,and may have an additional frve days within which to comply with the request,excluding <br /> Saturdays,Sundays and legal holidays. - <br /> Subd.4. Procedure when data is not accurate or complete An individua!may contest the accuracy or completeness of public or private <br /> data concerrring himself. To exercise this right, an rndivrdual shal!not�in writing the responsrble authority describing the nature of the <br /> disagreement. The resporrsible authority shal!within 30 days either. (a)correct the data found to be inaccurate or incomplete and attempt to not� <br /> past recipients of inqccurate or incomplete data,including recipients named by the individual,•or(b)not�the rndividual that he believes the data <br /> to be correct.
