-' � � . <br /> Sec.13.Od RIGHTS OFSUBJECTS OFDATA <br /> Subdrvrsion 1. Type of data. The rights of rndividual on whom the data is stored or to be stored shall be as set forth in this sectton. <br /> Subd.2. lnjormalion required to be given individuaL An individua!asked to supply private or confidential data concerning himselj <br /> shall be rnformed of. (a)the purpose and intended use of rhe requested data wrthin the collecting state agency,political subdrvisron,or sratewide <br /> system;(bJ whelher he may refuse or is lega[!y requi�ed to supply the requested data;(c)any known consequence arising from his supp(ying or <br /> refusing to supply private or confidentral data;and(d)the identiry of other persons or entities authorrzed by state or1'ederal lmv to receive the data. <br /> This requrrement shall not apply when an indivrdual is asked to supply investrgative data,pursuant to sectron 13.82, subdivision 5, to a law <br /> enforcemenl o�cer. <br /> The commissioner o(revenue may place the notice reqirired under thrs subdivrsion in 1he individua!income tax or propertv tai rerund <br /> instructions instead of on those jorms. <br /> Subd.3. Access to data by individuaL G'pon request 10 a responsible authority,an individual shall be rnformed whether he is the subject <br /> ojstored data on individuals, and whether it rs classrfred as public,private or canfrdential. Upon his further request,an individua!xho is the <br /> subject of stored private or public data on individuals shall be sholvn the data without any charge to him and, if he desires,shal!be informed of <br /> the content and meaning of that data. After an individua!has been shotivn the private data and informed of rts meaning, the data need not be <br /> disclosed to him for six months lhereafter unless a dispute or action pursuant to this section is pending or additronal data on the indivrdual has <br /> been collected or created. The responsible authorrry shall provide copies ojthe private or publrc data upon request by the indivrdua!subject of <br /> the data. The responsrble authority may require the requesting person to pay fhe actual costs of making,cert�ing,and compiling the copres. <br /> The responsible authorrty shall comply rmmediately,ijpossible,ivith any request made pursuant to this subdivision,or ivithin fn•e days <br /> of the date of the request,excluding Saturdays,Sundcry�s and legal holidays,rf immediate comp[iance rs no[possible. If he cannot comply with the <br /> request within that time,he shall so inform the individual,and may have an addrtional five days tivithin which to comply with the request,ezcluding <br /> Saturdays,Sundays and legal holidays. <br /> Subd.4. Procedure when data is not accurale or complete. An rndividua!may contest the accuracy or completeness ofp:�blrc or prrvate <br /> data concernrng himself. To exercise this right, an rndivrdual shall nol�in wrrting fhe responsible autharity describing the nature of the <br /> disagreement. The responsible authorityshall withrn 30 days either: (a)correct the data found to be inaccurate or incomplete and attempt to notify <br /> past recipients of inaccurate or incomplete data,including recipients named by the individual;or(b)notify the individual that he believes the data <br /> to be correct.
