� o� <br /> 0 0 <br /> CITY of OR4N0 <br /> � � <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��l ��'~ , .. <br /> `9kESI;�4' NO. - <br /> a) Penizanent docks are allowed by Conditiona]Use Permit in the floodway and <br /> flood fringe of Lake Minnetonka per the provisions of Orono Muiucipal Code <br /> Section 78-1116(a)(8). <br /> b) Docks which provide reasonable access to the lakeshore a�id do not exceed 8' <br /> in width are a permitted use within wetlands per the provisions of Municipal <br /> Code Sectioxi 78-1606(a)(4). <br /> c) The properiy abuts the shore of Lal:e Minnetonka,and the proposed dock will <br /> be constructed within a lake perimeter wetland and will provide reasonable <br /> access to the lake for the applicants' stated intent of nature enjoyment, <br /> fishing, etc. The dock is not specifically intended for boat storage. The <br /> proposed permaiient dock will be 100' in length eatending lal:eward from the <br /> shoreline, being 8' in width and having a"T"section at the lal:eward end of <br /> dimension 8' x 24'. <br /> d) The proposed dock location is within a small inlet connecting to Crystal Bay <br /> of Lake Minnetonka where wave and ice action will be niinimal, hence tlie <br /> stability of the dock will be at minunal risk, and will not require winter de- <br /> icing to maintain its integrity. <br /> e) The proposed permanent dock by virtue of its location in Lake Minnetonka <br /> is under the jurisdiction of the Lake Minnetonl:a Conservation District <br /> (LMCD) and is subject to the LMCD permitting process. <br /> fl The proposed pennanent dock will be located to meet LMCD setback, <br /> location and length standards and is not anticipated to result in conflicts with <br /> adjoining docks nor pose any navigation hazards. <br /> 4. The City Council finds that the conditions eaisting on this property are peculiar to it <br /> and do not apply generally to otller property in this zoiiiiig district, and that grantin� <br /> of the conditional use perinit would be in keeping with the spirit and intent of the <br /> Zoiiing Code and Comprehensive Plan of the City. <br /> Paoe 2 of� <br />
