Therefore, the driveway must be obliterated and restored with seed or <br /> sod (within the road right of way) by December l, 2002. <br /> Apparently, the current access to yours and other's properties is via an unimproved city street right of way <br /> (Westpoint Avenue), not an easement. If any subdivision of the property(s) were proposed, all access <br /> would have to be taken from an improved city street with appropriate ditch/slope grading to enhance <br /> sight-distance. <br /> However, the existing situation can best addressed by constructing a new "temparary" shared driveway <br /> roughly centered along your property frontage where visibility is more than adequate in both directions. <br /> If you wish to pursue this option, please fill out the enclosed permit application and submit it along with <br /> the appropriate easement documentation for other users and the permit would be approved subject to the <br /> elimination of formal access at the current Westpoint Avenue entrance.
