There is also an extension to the <br /> .lames N.Grathwol E o u t h f o T_' 3 b e P_L`h, <br /> Excelsior <br /> JoEllen L.Hurr <br /> o�o�o In Ju1y 1987 , a court order allowed the Narren ' s , former <br /> WiiliamA.Johnstone owners of your property, to construct a dock on the Dianis <br /> Minnetonka <br /> DuanePAarkus property. This was because your property has a 10 ' <br /> VJayzata easement for access to the lake and the deed includes the <br /> George C.Owen <br /> v��io��a right to build a dack. However � placing a dock on the <br /> TomPenn easement , which abuts the property line , would not comply <br /> TonkaBay with LMCD setback ordinances which require a 10 ' setback <br /> Robert Rascop <br /> Shorewood from the extended property line , regardless of any <br /> RoberiE.Slocum easements . Therefore , the court order allowed the Harrens <br /> Woodland to construct a dock which would abut the extension of the <br /> north boundary line of the 10—foot easement , bnt was not <br /> in any way to protrude into the 10 ' setback. <br /> Because this was allowed as a "grandfathered" situation , <br /> the dock must be maintained in the configuration and size <br /> that existed when the order was issued . The dock that <br /> existed at the time of the court order wae approximately <br /> 40 ' long with no canopy or side extensions .
