., Sec.13.04 RIGHTS OF SLTBJECTS OF DATA Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this secaon. Subd.2. Informadoa reqiared to be givw individual, ,e,n individual asked to svpply private or co�dential dara concerning himself shall be informed of: (a)the purpose and intended use of the requested data within the collecting state agency,polirical subdivuion,or statewide rystem;(b)whether he may refuse or is legally requind to supply the requested da[a;(c)any lrnown consequence arising from his supplying or refiuing to supply privare or confidendal dara;az�d(d)the idendry of other persons or enaties authorized by sate or federal law to receive the data. T6is requirement shall not apply when an individual is asked to supply investigadve data, pursuant to secdon 13.82, subdivision 5, to a law enforcement o�cer. Access to data by individual. Upon request to a responsible authoriry,an individual shall be informed whether he is the svbject of stored data on individuals,and whether it is classified as public,privau or co�denaal. Upon his further request,an individual who is the subject of stored private or public data on iadividuals shall be shown the data without any charge to him and,if he desires,shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning,the data need not be disclosed w him for six mond�s rhereafter unless a dispute or acdon punuant to this secaon is pending or addiaonal data on the individual has been copected or created. The responsible authoriry shail provide copies of the privare or public data upon request by the individual subject of the data. The responsible aurhoriry may require the requesting penon to pay the actual cosu of making,certifying,and compiling the copies. The responcible authority shall compiy immediately,if possible,with any request made pursuant to this subdivision,or widrin five days of the date of the request,excluding Saturdays,Sundays a�legal holidays,if immediate compliance is not possible. If he cannot comply with [he request within that time,he shall so inform the individual,and may have an addidonal five days within which to comply with the request, excluding Saturdays,Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individua!may contest the accuracy or completeaess of public or private data concerning himself. To exercise this right,an individual shall notify in writing the responsible authoriry deuribing the tiature of the disagreement. The responsible authoriry shal!within 30 days either. (a)correct the data found to be inaccurate or i�omplete and aaempt to¢oafy past recipient�of inaccurate or iexomplete data,iacluding recipienu named by the uidividual;or(b)norify the individual that he believes the data to be coaect. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determinadon of the responsible authoriry may be appealed pursuant W the provisioat of the adminisuaave procedure act relating w contested cases.
