The granting of the application is necessary for the preservation and <br /> enjoyment of a substantial property right of the Owner. <br /> n. The granting of the proposed variances will not in any way impair <br /> health, safety, comfort or morals, or in any other respect be contrary to <br /> the intent of this chapter. <br /> o. The granting of the requested variances will not merely serve as a <br /> convenience to the Owner, but is necessary to alleviate demonstrabte <br /> difficulty. <br /> p. The variances to redevelopment of the Property will alleviate a <br /> practical difficulty inherent to the Property and not created by the <br /> Owner. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the Applicant and the public, and the effect of the proposed <br /> variances on the health, safety and welfare of the community as well as the <br /> impact on properties in the vicinity. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar <br /> to it and do not apply generally to other property in this zoning district;that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the Owner, but is necessary to alleviate a practical <br /> difficulty; is necessary to preserve a substantial property right of the Owner; <br /> and would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants variances from Orono <br /> Orono City Code Section 78-420 in order to construct a new residence on the Property <br /> consisting of 163 feet of width and 0.89 acre is area for the Orono Portion and 11 feet of <br /> width and 0.15 acres in area for the Wayzata Portion where 2.0 acres in area and 200 feet in <br /> width are required; subject to the conditions listed below: <br /> 1. Council approval is based on the survey and building plans submitted by the <br /> Applicant and annotated by City staff, attached to this Resolution as Exhibits A 8� B. <br /> Page 3 of 5 <br />
