Stickney (hereinafter the "Applicant") on behalf of the <br /> owners of Lots 1,2,3,4,5,6,and 7,Block 1,MOONEY LAKE PRESERVE(hereinafter the"Lots") <br /> on October 7,2016 made an application to the City for variances to Orono Municipal Zoning Code <br /> Section 78-1279(6) in order to a11ow a new home on each Lot to be constructed lakeward of the . <br /> defined average lakeshore setback line where no such encroachment is normally allowed; and a <br /> variance to Section 78-128 to a11ow said variances to be applicable on a permanent basis rather <br /> than subject to the standard 1-year expiration if not used; and <br /> WHEREAS,on November 21,2016 after publisherl and mailed notice in accordance <br /> with Minnesota Statutes and the City Code,the Orono Planning Commission held a public hearing, <br /> at which time a11 persons desiring to be heard concerning this application were given the <br /> opportunity to speak thereon; and <br /> WI�REAS, on November 21, 2016, the Planning Commission on a vote of 6-0 <br /> recommended conditional approval of the variances; and <br /> WHEREAS,on December 12,2016,the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the requested variances as described above based on one or more.of the following <br /> findings of fact concerning this property: <br /> FINDINGS OF FACT: <br /> A1. The analysis contained within staff inemos and the exhibits attached to the aforesaid <br /> memos, all minutes from the above mentioned meetings, and any and all other materials <br /> distributed at these meetings are hereby incorporated by reference. <br /> A2. The Lots are located within the RR-1B Single Family Rural Residential District which <br /> requires a minimum lot area of 2.0 acres and a minimum lot width of 200' for construction <br /> of a single family residence. " <br />
