MINUTES OF THE <br /> ORONO CITY COUNCIL MEETING <br /> Monday,July 10,2017 <br /> 7:00 o'clock p.m. <br /> 13. #17-3933 CATHERINE SWEET,3405 AND 3407 CRYSTAL BAY ROAD,VACATION <br /> OF STREET-ConHnued <br /> Barnhart displayed a survey of the two properties. Barnhart noted the City vacated the street that was <br /> created in 1908 and then created a new right-of-way as a result of that vacation.Barnhart stated in the <br /> event the property owner wished to donate an easement or a right-of-way in another location,there would <br /> need to be another public hearing and a variance would also likely need to be granted to the 0-75 foot <br /> setback. <br /> Seals stated she would agree that the other property owner should be notified of the possible relocation. <br /> Crosby asked how much of a variance would be required. <br /> Barnhart stated to his understanding the 75-foot line gces through most of the homes in the area. <br /> Walsh noted the City Attorney found out today that Crystal Bay Road is not owned by the City and is <br /> instead owned in part by each of the residents that live on the road,which also raises some questions. <br /> Printup moved,Seals seconded,to direct Staff to draft a denial resolution for Application No. <br /> #17-3933,Catherine Sweet,3405 and 3407 Crystal Bay Road. <br /> Walsh asked whether the Council would like to consider tabling the application to look at relocating the <br /> right-of-way. <br /> Crosby stated he would like to see that. <br /> Barnhart stated there are two options the Council can consider: the Council can direct staff to draft a <br /> denial resolution or the applicant can waive her 60-day time period to allow for additional time to look at <br /> relocating the right-of-way. <br /> Sweet indicated she would waive the 60-day review period. <br /> Printup withdrew his motion. <br /> Crosby moved,Seals seconded,to table Application No.#17-3933,Catherine Sweet,3405 and 3407 <br /> Crystal Bay Road. VOTE: Ayes 5,Nays 0. <br /> 14. #17-3944 WESTWOOD PROFESSIONAL SERVICES ON BEHALF OF UGORETS <br /> 8098 LLC,2520 SHADYWOOD ROAD,REZONING AND MASTER PLAN APPROVAL <br /> Barnhart reviewed his Staff report dated July 10,2017,regarding rezoning to RPUD and a master plan <br /> review for a proposed 40-unit condominium on 3.11 acres. The Planning Commission recommended <br /> denial of the project due to concerns with building height and impacts to traffic. Staff recommends <br /> approval subject to Council direction on the height. <br /> Seals asked what Staff ineans by they generally support this plan. <br /> Barnhart stated the City has certain areas that have been identified for higher density and this is one of <br /> those areas. Staff supports it from a general perspective since there is infrastructure available such as <br /> Page 6 of 14 <br />
