. �-o�o <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � ti <br /> � �,� f .41Z <br /> NO. <br /> rAKES H��� <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 14-3670. <br /> 2. The Property is located in the LR-1A One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 2.0 acres and a minimum lot width <br /> of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> May 19, 2014 and voted 7 for and 0 against on a motion to approve the <br /> variances and conditional use permit. The Planning Commission finds that the <br /> following factors support the granting of the request: <br /> a. The Property has 10.1 acres ir� area (or 441,332 square feet). Including the <br /> adjacent properties the Owners own approximately 15 acres of land. <br /> b. The Property has approximately 400 feet of width at the OHWL and <br /> _ approximately 407 feet at the 75-foot setback <br /> c. The existing stair is deteriorated. The new stair is essential in order to access <br /> the lakeshore over the steep slope and is necessary for the Owners' <br /> enjoyment of the Property. The meandering in-grade stair will serve to better <br /> protect and stabilize the slope than an above grade stair where erosion can <br /> occur beneath. <br /> d. The proposed additional hardcover resulting from the meandering stair and <br /> low walls is reasonable, consistent with the comprehensive plan and will not <br /> alter the character of the area. <br /> e. The Owner has provided a landscape plan which will serve to screen and <br /> mitigate views of the proposed stairs (and small walls) and armored swale <br /> from the lake. <br /> f. The hardcover within the.0-75' zone should not increase with the installation <br /> of the new fake access stair and reorientation of the lake access path. With <br /> approximately 54,372 square feet or 12.3% overall hardcover, the Property <br /> will conform to the hardcover limitations of a Tier 1 lot. <br /> Page 2 of 5 <br />
