� � <br /> Sec.13.04 RIGHTS OF SUBJECTS OF DATA ♦ <br /> Subd.1. Type of data. The rights of indlvidual on whom the data is stored or to be stored shall be as set forth in this section. <br /> Subd.2. Ioformation required to be given individual. An individual asked to supply private or contldenttal data concerning himself shall be <br /> Informed of: (a)the purpose and intended use of the requested data within the collecting state agency,political subd'nivon,or statewide system;(b) <br /> whether he may refuse or ls legaliy required to supply t6e requested data;(c)any known consequence arising from 6is snpptying or refusing to supply <br /> private or contldential data;and(d)t6e identity of other persons or enrities sut6orized by state or federal Iaw to receive the data.This requtrement shall <br /> not apply when an individual is asked to supply investigative data,pursuant w section 13.82,subdlviston 5,to a Iaw enforcement ofticer. <br /> The commissioner of revenue mav olace the notice reauired under this subdivision in the indlvidual income tax or orooertv tax retund <br /> instructions instead of on those forms. <br /> Subd.3. Access to data by individual. Upon request to a rrsponsible authority,an Individual shall be informed whether he is the subject of <br /> stored data on individuals,and whether it is classltied as public,prn-ue or confidential. Upon his further request,an indi�idual who is the subject of <br /> stored private or public data on individuals shsli be s6own the data�rithout any c6arge to hlm and,if 6e desires,shall be informed of t6e cootent and <br /> meaning of thst data. After an indlvidual has been shown the pri�•ate data and informed of its meaning,the data need not be disclosed to him for six <br /> months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been rnllected or created. The <br /> responsible authority shall provide rnpies of the private or public datx apon request by the individual subJect of the data. TLe responsible authority may <br /> require the requesting person to pay the actual wsts of making,certif�ing,and compiling t6e copies. <br /> The responsible authority shall comply immediately,if poss�le,wit6 aay request made pursuant to t6is subdi�-ision,or within five days of the <br /> date of the request,excluding Saturdays,Sundays snd legal holidays,if immediate compliance is not possible.If he cannot eomply with the request within <br /> that tlme,6e shall so laform the individual,and may have an additional Gve dacs within which to rnmply with the request,ezcluding Saturdays,Sundays <br /> and legal holidays. <br /> Subd.4. Procedure when data is not accurate or complete.:+�n indh�dual may contest the accuracy or completeness of public or private data <br /> rnncerning himself. To exercise thls right,an indlvidual shall notify in W ritiug the responsible authority describing t6e namre of the dlsagreement The <br /> responsible suthority shall within 30 days either: (a)correct the dara[ound w be inaccurate or incomplete and attempt to notify past recipients of <br /> inaccurate or Incomplete data,tncluding reclpients named by t6e indi�idual;or(b)notify the individual that he believes the data to be rnrrect. Data in <br /> dispute shall be dlsclosed only if the individual's ststement of dlsagreement is included wit6 the disclosed data. <br /> The determination of the responsible authority may be sppealed pursuant to the provistons oi the administram-e procedure act relating to <br /> contested cases. <br /> .
