• � <br /> , ., , <br /> , , <br /> CITY OF ORONO <br /> HENNEPIN COUNTY, MINNESOTA <br /> RIGHT-OF-WAY <br /> PERMIT AGREEMENT <br /> 1. RIGHT-OF-WAY PERMIT. Subject to the terms and conditions established by <br /> city inances d as set forth herein,the CITY OF ORONO ("City")hereby grants a permit <br /> to (�[.C� ("Permittee")to allow the use of publicly owned or managed <br /> rights-of- ay for the installation,repair, and maintenance of a sewer stub and road repair at <br /> 1565 Maple Place. Permittee agrees to the terms of this Right-of-Way Permit Agreement. <br /> 2. PROPERTY. The right-of-way permit is for the right-of-way located in the City <br /> of Orono, County of Hennepin, State of Minnesota, described and depicted on the attached <br /> Exhibit"A". <br /> 3. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of <br /> this Permit Agreement,the Pernuttee shall deposit Five Thousand and no/100ths ($5,000.00) <br /> Dollars with the City. All accrued interest, if any, shall be paid to the City to reimburse the City <br /> for its cost in administering the escrow account. <br /> 4. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee <br /> reimbursement to the City for all out-of-pocket costs the City has incurred to repair any damage <br /> to public property,right-of-way, or infrastructure that is caused by the work(including planning, <br /> engineering, or legal consultant review) associated with the installation of a sanitary sewer <br /> stub. Eligible expenses shall be consistent with expenses the CiTy would incur to correct any <br /> issues related to construction in the City's right-of-way. <br /> 5. CONDITIONS. The permit is issued subject to the following conditions: <br /> A. Permittee will comply with Minnesota Statutes § 216D.01-.09 (the State's <br /> One Call Excavation Notice System)prior to conducting any work in the <br /> right-of-way. <br /> B. The Permittee's construction,reconstruction, operation,repair, <br /> maintenance, and location of 1565 Maple Place shall be subject to other <br /> reasonable regulations of the City. <br /> C. The Permittee shall not open or disturb the paved surface of any public <br /> right-of-way for any purpose without first having obtained permission <br /> from the City, for which the City may impose reasonable conditions. <br /> D. After undertaking any work in the right-of-way,the Permittee shall restore <br /> the same, including paving and its foundation,to as good condition as <br /> formerly existed, and shall maintain the same in good condition for two <br /> 166160 1 <br />
