r � <br /> � O� <br /> O <br /> � �a�� � ITY f ORONO <br /> ,� . _:, �„ <br /> C o <br /> �'',� ' `� ' / G'�' RESOLUTION OF THE CITY COUNCIL <br /> �`�.kE°sKo�� rvo. 5 4 9 �� <br /> A RESOLUTION GRANTING CONCEPTUAL APPROVAL <br /> FOR THE VACATION OF MANOR CIRCL�, <br /> FOR THE VACATIOl�' OF C�RTAIN EIISTING <br /> DRAINAGE AND UTILITY EASEMENTS, <br /> AND GRANTING PRELIMINARY PLAT APPROVAL <br /> FOR PROPERTIES LOCATED AT 130 AND 145 MANOR CIRCLE <br /> FIL� NO. 06-3218 <br /> WHEREAS, Julie Morrison-Aiz1e & Brian Anle and Itei-��y & I�iaiuz Nassauer <br /> (hereinafter the "Owners") are o�z-ners of the properties within tl�e City of Orono (hereinafter the <br /> "City") located at 130 and 145 Manor Circle and le�ally described as follows: <br /> 130 Manor Circle (Monison-Arne): <br /> Lot 1, Block 1, Countryside Manor 2°d Addition, Hennepin Count��, Minnesota <br /> 14� ylanor Circle (Nassauerj: <br /> Lot l., Block 2, Countiyside Manor 2"� Addition, Hennepin County, Minnesot�► <br /> (hereinafter the "Properties"); and <br /> VV�-IEREAS, the Properties are separated by a platted public road kno«n1 as <br /> Manor Circle. �vhicl� road was platted and dedicated within the plat of Countryside Manor 2"d <br /> Addition in 1984, and �vhich provides road access to the Properties from the private road lazown <br /> as Countryside Drive, via a paveci roaciway and cui-de-sa� c�teiiuing apprcxili�ately half the <br /> len�th of the e�istin� dedicated Manor Circle. right-of-way; and <br /> WHER�AS, it is evident fi�om City records that Manor Circle was incon�ectly <br /> platted by the developer as a public road rather than a private road, and that the City intended for <br /> Manor Circle to be platted as a private road outlot; and <br /> `�'HER�AS, Countryside I��lanor 2"� Addition tivas the second phase of a 4-phase <br /> subdivision process of the fornler 80-acre Dickey property. Durin� development of the Dickey <br /> property, provisions were made in the various phases to have all new lots served by 1n ii�te�ral <br /> interior road system, minimizin� drivewa�� or private road accesses directly to the sun�oundin` <br /> City roads (Willow, Watertown, Old Crystal Bay). To that end, Manor Circle was platted to the <br /> IlUlili boun�iary o� Countrysid� P�-lanor �nd Addition with the expzctation that it would be <br /> e�tended to the north to ser��e future lots.
