` � � <br /> MEMORANDUM IN SUPPORT OF � <br /> DECISION FINDING TEMPORARY CERTIFICATE <br /> OF OCCUPANCY REVOKED <br /> AND HOUSE AT 3536 LY�2IC AVENUE <br /> IN VIOLATION OF UNIFORM BUILDING CODE <br /> FACTS <br /> The structurally inferior condition of the house located at 3536 <br /> Lyric Avenue ("house") and presently owned by Mr. Charles Henke has <br /> been of issue with the City of Orono ("City" ) for many years . The <br /> house lacks a structurally solid foundation and footings and <br /> instead is precariously resting on cement blocks which do not <br /> adhere to each other . Furthermore, the cement blocks do not extend <br /> below the frost line. Such a condition is in violation of the <br /> Uniform Building Code (UBC) and the State Building Code (SBC� <br /> Section 2907 . In addition to the footing and foundation <br /> violations , the roof on the house is in a state of disrepair and <br /> does not provide adequate protection from the elements . As such, <br /> the roof is in violation of UBC/SBC, Sectio�. 3212 . <br /> Mr. Henke was allowed to move into the house on December 23, <br /> 1983, on the condition that he comply with the UBC/SBC by <br /> installing footings, a foundation, and by repairing the roof . <br /> July 31, 1983 , was the agreed upon completion date. Such <br /> conditions were set forth in a Temporary Certificate of Occupancy. <br /> : Mr. Henke signed the Temporary Certificate of Occupancy and moved <br /> into the house with full knowledge of the City' s expectations and <br /> the fact that he was in violation of the respective codes . The <br /> City, as testified to at the hearing, would not have issued the <br /> Temporary Certificate of Occupancy had the City staff knowledge <br />
