UBC §§ 2907(a) ; 2907(b). <br /> 10. On February 23, 1983, a temporary Certificate of Occupancy aas• issued <br /> to Mr. Henke. Henke Ex. G. 7he temporary Certificate of Occupancy required <br /> the installation of footings and a foundation for the structure, in accordance <br /> with the Uniform Building Code, to be completed by July 31 , 1983, and a <br /> reroofing of the structure, also in accordance with the Code, to be completed <br /> by July 31 , 1983. Although Mr. Henke signed the temporary Certificate of <br /> Occupancy agreeing to make the corrections, his only alternative to signing <br /> the document would have been to vacate the premises, where he was then living. <br /> 11 . The structure at 3536 Lyric Avenue was initially built nbout 1935 and <br /> was, certainly, standing prior to the adoption of any applicable bullding code <br /> by the City of Orono or the State of Minnesota. Henke Ex. E; Henke Ex. F. <br /> 12. The support for the house consists of stacked cement blocks placed at <br /> the corners of the structure. City Ex. 4; City Ex. 5. The blocks have no <br /> mortar or other fixative as now required by the Uniform Building Code. The <br /> weight of the house presses the blocks together, supporting the structure. <br /> The cement blocks currently used are not the original support blocks. They <br /> have been replaced periodically as needed. <br /> 13. There is no evidence in the record that any footings for the <br /> strutture extend down into the frost line as now required by the tlnlfcrm <br /> Building Code. <br /> 14. Since the date of the photographs showing the condition of the <br /> support for the house, September 21 � 1984, the metal I beam shown under a <br /> portion of the structure has been removed. It was not required to support the <br /> structure but was apparently used as a point of leverage when blocks were <br /> requlred to be replaced. <br /> 15. The terrain upon which the blocks rest is unfinished, conslsting of <br /> loose earth sub�ect to erosion and movement from ctimatic conditions. City <br /> Ex. 4; City Ex. 5. No other structure in the area is supported solely by <br /> unmortared, stacked blocks resting on unimproved ground. <br /> 16. The improvements made to the interior of the house have placed an <br /> additional load on the support structure. � <br /> 17. In July of 1983, Mr. Henke ob�ected to making the repairs required in <br /> the conditional Certificate of Occupancy and refused to install etther � <br /> footings or a foundation as now required by the Uniform Building Code. <br /> 18. On July 19. 1983, City officlals, including the Bullding Inspector, <br /> � met with Mr. Henke at his property and discussed with him the use of a wood <br /> � foundation and alternative.pier footings. �Mr. Henke refused to use any of the <br /> less costly alternatives suggested by Mr. Jacobs. <br /> 19. On an unspecified.date in 1983, after the July 19, 1983 meeting, Mr. <br /> Henke was cited for a criminal violation of the ordinances of the City of <br /> Orono because of his failure to comply with the temporary Certificate of <br /> -3- <br />
