provisions and requirements of Section S15B.3-i 13 of the Act. _ <br /> ARTICLE IX. <br /> Reconstr_uction,Repair or Replacement ' <br /> After Casualty Damage and <br /> Condemnation and Eminent Domain <br /> 1. Procedures for Repair, Reconstruction or Disposition Following Damage or <br /> Destruction.The procedures for the repair,reconstruction or disposition of the <br /> Condominium following damage to or deshvction thereof shall be governed by the <br /> provisions of Section S 15B.3-113(h), (i) and(j)of the Act, and any repair or <br /> reconstruction shall be substantially in accordance with the plans and specifications of the <br /> Condominium as initially constructed and subsequently improved upon. Notice of <br /> substantial damage or destruction shall be given pursuant to Section 3 of this Article IX <br /> hereinbelow. <br /> 2. Procedures in Case of Taking of Part or All of Condominium by Condemnation or <br /> Eminent Domain. In the event of a taking of any part of the Condominium by <br /> condemnation or eminent domain, the provision of Section S 15B.1-107 of the Act shall <br /> govern and notice shall be given pursuant to Section 3 of this Article IX hereinbelow. <br /> 3. Notice to First Mortgagees.All first mortgagees shall be entitled to receive notice of <br /> any and all condemnation proceedings or substantial damage to or destruction of the <br /> Condominium, and the Association shall give written notice thereof to all first <br /> mortgagees promptly after occunence of the damage or destruction or commencement of <br /> the condemnation proceeding. First mortgagees shall be entitled to priority for <br /> condemnation awards in accordance with the priorities established by the Act and this <br /> Declaration and the Articles of Incorporation and the Bylaws of the Association, as their <br /> interests may appear. <br /> ARTICLE X. <br /> Amendment <br /> This Declaration may be amended by an affirmative vote of at least 75%of the total voting <br /> power of the Association (i)in writing, or (ii)at a meeting of the Association duly held in <br /> accordance with the provisions of the Bylaws.Any amendment shall be subject to the rights of <br /> first mortgagees as set forth in the next Article hereof and such greater requirements as may be <br /> imposed by the Act, and shall be effective only when recorded in the office of the Hennepin <br /> County Registrar of Titles. In the case of an amendment by vote at a meeting of the unit owners, <br /> an acknowledgrnent by the Secretary or other officer of the Association as to the procedural <br /> sufficiency of the vote shall be adequate evidence thereof for all purposes, including without <br /> limitation the recording of the amendment. <br /> ARTICLE XI. <br /> Mortgagee Requirements <br />
