<br /> NOW, THEREFORE, Declarant, as the owner of the real estate hereinbefore described -
<br /> and for the purposes above set forth, hereby declares as follows:
<br /> ARTICLE I. Definitions �
<br /> The terms and phrases used in this Declaration shall have the meanings ascribed to them
<br /> in Section S15B.1-103 of the Act except as those meanings are modified or supplemented herein
<br /> below. To aid in the review of this Declaration, the Act definitions, or portions of such
<br /> definitions, of some frequently used terms and phrases are set forth in qaotation marks. The
<br /> clauses not contained within quotation marks are modifications of or additions to the Act
<br /> definitions.
<br /> 1. Association. "Association" means the unit owners association organized under Section
<br /> S15B.3-101" of the Act in general and in particular LAKE MINNETONKA
<br /> MEADOWS, a non-profit corporation organized under Chapter 317A of Minnesota
<br /> Statutes, as amended of which each unit owner shall by virtue of his ownership interest
<br /> be a member, and which has been established for the purposes of administering,
<br /> managing, maintaining, operating, repairing, altering and improving the common elects
<br /> of the Condominium for the collective benefit of the members.
<br /> 2. Bylaws. The Bylaws adopted by the first Board of Directors of the Association on or
<br /> before the date hereof which governs the operation of the Association.
<br /> 3. CIC Documents. This Declaration and the Articles of Incorporation, Bylaws and Rules
<br /> and Regulations adopted by the Association, and all amendments thereto.
<br /> 4. CIC Plat. "CIC plat" means a common interest community plat described in Section
<br /> S 15B.2-1101 of the Act."
<br /> 5. Common Elements. "Common elements" means all portions of the common interest
<br /> community other than the units" including, but not limited to, the following: The exterior
<br /> masonry, and framing: interior and exterior windows, components thereof (including
<br /> glass), and the frames thereof; foundations, columns, girders, and beams: footings,
<br /> concrete slabs, concrete basement floors, concrete subfloors; interior load-bearing walls;
<br /> walls separating units from corridors, stairs and mechanical installations; pipes, vents,
<br /> flues, chutes, chimneys, wires, conduits and other utility installations (which may lie
<br /> partially within and partially without the designated boundaries of a unit but which serve
<br /> more than on unit or any portion of the common elements) to the outlets thereof in each
<br /> unit, but excluding individual connections and valves at such outlets; roof and roofing
<br /> materials; stairways and stairwells; lobbies and corridors; mail area; land, grounds,
<br /> patios, fountains, atriums, courtyards, balconies, decks, fence screening, shrubbery,
<br /> plants, trees, ramps and gardens; pazking areas and driveway areas; all central and
<br /> appurtenant equipment installed for such services as power, light, telephone, gas,
<br /> ventilation, hot and cold water, and like utilities, and all spaces occupied by such
<br /> mechanical equipment; laundry area; and any other area, facility, fixture or element
<br /> which is designed or intended for common use.
