The project will be monitored by the City and MCWD to prevent erosion from <br /> the site. <br /> 14.All exterior lighting shall be so directed so as not to cast glare toward or onto the public <br /> right-of-way or neighboring residential uses or districts; There should be no lighting or <br /> glare resulting from the grading project. <br /> 15. Not detrimental to the public health, public safety, or general welfare. See#12 above. <br /> CONCLUSIONS. ORDER AND CONDITIONS: <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a variance to Orono Municipal Zoning Code Section 78-305 to a�low construction of a new <br /> home on the Property which is 1.6 acres in area and has 133 feet in width where 2.0 acres and <br /> 200 feet of width are required; a variance to Orono Municipal Zoning Code Section 78-305 to <br /> allow construction of a new home located 34.8 feet from the side street property line where a 50- <br /> foot setback is normally required; and a CUP pursuant to Orono Municipal Zoning Code Sections <br /> 78-966 and 78-967 to permit the export of approximately 2,000 cubic yards of earth material from <br /> the Property, subject to the following conditions: <br /> 1. Council approval is based on the survey and grading plan by Frank R. Cardarelle dated <br /> 09/17/14 and revised 03/28/16, the landscape plan by Yardscapes, Inc., dated 04/01/16, <br /> and the building plans submitted by the Applicants and annotated by City staff, attached <br /> to this Resolution as Exhibits A, B, 8�C (hereinafter the "Plans"). Any amendments to the <br /> Plans which are not in conformity with City codes may require further Planning <br /> Commission and City Council review. <br /> 2. A haul route shall be submitted to the City Engineer for approval and inspection prior to <br /> commencement of hauling from the site. The property owner shall be responsible for <br /> cleaning and repair of roadways for any adverse impacts. <br /> 7 <br />
