1 3 Y � <br /> � � <br /> , �O� �c{oc�� <br /> � C ITY aF ORQNO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � � <br /> � G~ <br /> I�xESH��� N�. _ � � � <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE SECTION 78-305 <br /> AND APPROVING A CONDITIONAL USE PERMIT PURSUANT <br /> TO MUNICIPAL ZONING CODE SECTIONS 78-966 8� 78-967 <br /> FILE NO. 1&3803 <br /> WHEREAS,on December 16,2015,Tashitaa Tashoo Tufaa and Nediyo Gemechu <br /> Sado, husband and wife (hereinafter the "Applicants"), are the owners of the property located at <br /> 1830 Shoreline Drive and legally described as: <br /> Lots 1 and 1A, Auditor's Subdivision No. 356, Hennepin County, Minnesota <br /> (hereinafter the"Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-305 to allow construction of a new home on <br /> a property 1.6 acres in area and having 133 feet in width where 2.0 acres and 200 feet of width <br /> are required; and <br /> WHEREAS, the Applicants have made apptication to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-305 to allow construction of a new home <br /> located 34.8 feet from the side street property line where a 50-foot setback is normally required; <br /> and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> conditional use permit(hereinafter the"CUP") pursuant to Orono Municipal Zoning Code Sections <br /> 78-966 and 78-967 to permit the export of approximately 2,000 cubic yards of earth material from <br /> the site; and <br /> WHEREAS, on January 19, 2016, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the City Council held a public hearing, at which time <br /> all persons desiring to be heard concerning this application were given the opportunity to speak <br /> thereon; and <br /> WHEREAS, on January 19, 2016, the Planning Commission recommended <br /> approval of the variances and CUP; and <br /> 1 <br />
