w . <br /> � <br /> � � <br /> O O <br /> �b - CITY of ORONO <br /> � -�- ti <br /> '� RESOLUTION OF THE CITY COUNCIL <br /> ��9kESH�4�'� NO. � � '� �`� <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.23, SUBDIVISION 6 (B); <br /> SECTION 10.56, SUBDIVISION 16 (C - 2), (.n AND (L) AND <br /> GRANTING A CONDITIONAL USE PERMIT PER <br /> SECTION 10.03, SUBDIVISIONS 19-21 <br /> FILE NO. #2403 <br /> WHEREAS, Terry and Bruce Clark (hereinafter "the applicants") are the owners <br /> of the property located at 1575 Long Lake Boulevard within the City of Orono (hereinafter "the <br /> City") and legally described as follows: <br /> Lots 13, 14, 15 and the West half of Lot 16, Albee's Long Lake Addition, <br /> Hennepin County, MN (hereinafter "the property"); and <br /> VVHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br /> held a public hearing on August 17 and September 21, 1998, at which times all persons <br /> desiring to be heard concerning this application were given the opportunity to speak thereon; <br /> and <br /> WHEREAS, the applicants have applied to the City for variances to Municipal <br /> Zoning Code Section 10.23, Subdivision 6 (B) and Section 10.56 16 (C - 2), (� and (L) to <br /> permit a 12' x 16' entry addition to an existing residence on the street side and a deck and � <br /> stairwa}� on the lakeside where the existing residence is partially located in both the required <br /> street and 75' setback from the shoreline, and to allow the existing residence to be raised 4' to <br /> construct a basement walkout requiring a net increase of 15 cubic yards of fill in the required <br /> lakeshore setback and within the required top of bluff setback. A hardcover variance in the <br /> 0-7�' setback is required to allow 7.10% (1,467 sq. ft.) where 6.0% (1,223 sq. ft.) is e�cisting <br /> and none is allowed. A conditional use permit per Section 10.03, Subdivisions 19-21 is <br /> required for land alteration in the lakeshore setback. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> Page 1 of 5 <br />
