� � , � Sec.13.04 RIGHTSOFSUBJECTSOFDATA Subdivrsion 1. Type ojdatra The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd.2. InjarmaHon requlred to be given individuaL An individual asked to supply privaJe or conftdentia!data concerning himselj shal!be informed of. (a)the purpose and intended use of the requested dara within the collecting state agency,political subdivision,or statewide system;(6J whether he may refuse or is legally required to supply!he requested data;(c)arry/rnown consequence arising from his supplyrng or refusing to supplyprrvate or confulextial data;and(d)the identity of other persorrs or entities authorized by state or federal law to receive the data. This�equirement shal!not apply ivhen an individual is asked to supply imestigative data,pursuant to sectiox/3.82, subdivrston S, to a law enforcement offrcen The commrssioner ofrevenue mav nlace the notice reouired under this subdivision in lhe individual income tax or nronertv tax refund instructions instead of on those forms. Subd.3. Access to data by individuaL Upon request to a responsible authority,an individual shall be injormed whether he is the subject of stored data on indrviduals,and whether it rs classified as public,private or confidential. Upon his further request,an individual who rs the subject of stored private or public data on individuals shall be shown the data without arry charge to him and,if he desires,shall be informed of the content and meanrng of that data. After an individual has been shown the private dala and rnformed af its meaning, the data need not be disclosed to him jor six months thereafter unless a dispute or action pursuant to this section is pending or additiona[dctta on the individual has been collected or created. The responsible authority sha11 provide copies ojthe private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making,cert�ing,and compi[ing the copies. The responsible authority shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days of�he date oJthe request,excluding Saturdays,Sundays and lega!holydays,rf immediale compliance is not possible. 1,f he cannot comply with!he request within that time,he shall so rnform the indrvidual,and rr�ay have an additronal five days within whrch to comply with the request,excluding Saturdays,Sundays and legal holidays. Subd.4. Procedure when data is not accutate or complete An individua!may contest the accuracy or completexess ofpublic or private data concerning himselJ. To exercise lhis right, an individual shal[not�in writing!he responsible authority describrng the nature of the disagreement. The responsible authority shall within 30 days either: (a)correct the datafound to be inaccurate or incomplete and attempt to not� past recipients of rnaccurate or incomplete data,includrng recipients named by the individual;or(b)not�the individual that he believes the dala to be correct. Data in dispute shall be disclosed only rf the individual's statement of disagreement is included with the drsclosed data. The determination of the responsible authority may be appealed pursuant to the provisions of the administrative proceduse act relating to contested cases.
