MINOTES OF THE REGULAR COUNCIL MFETING HELD JANUARY 14 , 1985 PAGE 3 <br /> Wheeler stated that he didn ' t feel that he was <br /> appealing anything. Wheeler stated that if the <br /> Council felt he was appealing something, he asked that <br /> the Council waive thatfee. Wheeler asked the Council <br /> that when they address this appealing fee to be <br /> increased later tonight , that they consider what that <br /> fee is really for. 4�iheeler stated that when an Orono <br /> resident has to pay a $100 or $200 fee to ask to have the <br /> laws enforced equally, that that is abusive and isn' t <br /> the intent of the law. <br /> Jerry Wheeler submitted a copy of the beginning of a <br /> petition asking that these laws be enforced equally. <br /> Wheeler noted that the petition has approximately 70 <br /> names on it and will have many more when he is finished <br /> with the petition. Wheeler felt that it was the Orono <br /> resident ' s wish to have our laws equally enforced . <br /> Niayor Butler replied that when Wheeler was here before <br /> complaining about the boat next door, the Council <br /> discussed it and the bottom line of that discussion was <br /> for the City to enforce that particular ordinance city- <br /> wide would mean that if nothing else the City would have <br /> to hire additional staff . Butler noted that the <br /> Council decided that they would do nothing two years ago <br /> which was Wheeler ' s answer. Butler explained that to <br /> enforce the ordinance would open a level of effort that <br /> we are not staffed for . Butler told Wheeler that the <br /> City has since then had discussions about changing the <br /> ordinance in light of the fact that as the ordinances is <br /> written now, it is unenforceable with the City of Orono. <br /> Jerry Wheeler replied that when he appeared last year <br /> that he appeared on one issue only, and it was not the <br /> boat issue. Wheeler told the N,ayor that she <br /> unilaterally refused to discuss the issue that he <br /> appeared on, and without any Councilmember ' s knowledge <br /> of what was going on, made a statement in support of Mr. <br /> Johnson' s violation of our city laws . Wheeler stated � <br /> that the Councilmembers were not informed of the issue. <br /> Wheeler explained that the City doesn ' t have to hire <br /> additional staff to enforce this ordinance. Wheeler <br /> stated that the staff could merely respond upon <br /> complaint. <br /> Zoning Administrator Mabusth mentioned that Mr. Eller <br /> was not ticketed and was out of town at the time and then <br /> cameintostaffafterreceiving a letter. Mabusth told <br /> Eller at that time that he should come in for a variance <br /> application. Mabusth noted that even some Council- <br /> membershave over-sized boats stored on their property <br /> along with many other Orono residents . Mabusth <br /> explained the problems that residents have in meeting <br /> the ordinance standards : topographical concerns , <br /> inability to meet the required setbacks setup by the <br /> performance standards , size of boat ( 20 ' boats cannot <br /> be stored on property) . <br />
