t Sec.13.04 RIGHTS OF SUBJECTS OF DATA Subd. 1. Type of data. The rights of individual oa whom the data i3 stored or to be stored shall be as set forth in this secrion. Subd.2. An individual asiced co suPPly private or confidendal data conce�ning himself shall be informed of: (a)the purpose and iacec�ded use of the cequested data wi@iin the collecdng rtate agency,potidcal subdivision,or stauwide rysum: (b)whether he may refu;e ot is legally required to supply the requesoed data;(c)any laiown consequence arising from his supplying or retusing to supply privace or confidential data;and(d)ehe idendry of o[her persons oc enades auchorized by state or fedecal law to roceive the data. This requirement shall not apply when an individual is uked to supply invesdgadve daa,pursuant to ucdon 13.82, subdivision S, to a law enforcement o�cer. Aceess to data by individual. Upon requesc to a respoasible authority,an individual shall be informed whether he is the subject of stored daq on individuals,and whe[her it is class�ed as public,private or conflslendal. Upon his further request,an individual who is the subjecc of stored private or public data on individuals shall be shown the dara wichout any charge to him and;if he desires,shall be informed of the content and meaning of rhat data. Afur an individual hu been shown che private data and informed of its meaniag,the data need not be disclosed to him for six months thereafur unless a dispute or action pursuanc w ehis secdon is pending or addiaonal data on the individual has been collecud or croaced. The respoasible auihoriry shall provide copies of the privarc or public data upon request by the individual subjecc of tiu data. The rosponsible authoriry may require the requesting person w pay the actual cosu of malcing.cerafying.and cOmP��B��,�pies. . The responsible aurhoriry shaU comply immediately,if possible,wich any rcque3t made pursuant to this subdivision,or widiin ftve days of the date of the request,excluding Saairdays.Sundays and legal holidays,if immediace compliance is�t possible. If he cannot comply with the request wi�hin that time,he shall so inform che individual,and may have an addidoaal 8ve days within which to comply with the request,excluding Saturdays, Sundays and legal holidays. , Subd.4. Procedure whea data is not accurate or complete. M individual may contest the accuncy or completeness of public or private data concerning hirtuelf. To exercise rhis right,an individual shall notify in wridag the respoatible authoriry describing rhe naaire of the disagnement. The responsibie authoriry shall within 30 days either: (a)correct the data found to be inaccucate or i�omplea and aaempt W nodfy past ncipienu of inaccurdte or incomplete data, including recipients named by the individual;or(b)notify the iadividual that he believes the data to be correcG Data in dispute shall be disclosed only if the individual's statemenc of disagreemenc is included with[he disclosed data. The decerminadon of the responsible auehoriry may be appealed pursuant to[he provisions of the adminisaadve procedure act reladng to contested cases.
