Butler stated that <br /> they are out in the field wiring. <br /> T�SPORTATION REPORT Councilmember Adams stated that he will be attending a <br /> chamber luncheon concerning County Road 15 and asked <br /> for any comments from the Council. <br /> BID AWARD <br /> PUNCH CARD VOTING <br /> SYSTEM Geoffrey Ryan and Otto Johannes of Miller-Davis was <br /> present. Herb Reissner of ElMarketing were present. <br /> Public Works Coordinator Gerhardson noted that at the <br /> time of the bid, Miller-Davis ' equipment was not <br /> certified by the State of Minnesota . <br /> City Attorney Malkerson stated that the absence of the <br /> certification of Miller-Davis at the time of the bid <br /> opening is a substantial omission. Malkerson stated <br /> that the City probably could not award the bid to <br /> Miller-Davis legally. Malkerson stated that the <br /> City can take the next bid which would be from E1 <br /> Marketing or discard all bids and hold another bid. <br /> Geoffrey Ryan stated that the State of Minnesota <br /> certif ied the same equipment three years ago but that <br /> they just wanted to check the minor changes in the <br /> equipment. Ryan stated that the State of Minnesota <br /> did not get the certification to Miller-Davis until <br /> today. <br /> City Attorney Malkerson stated that the certificate <br /> was not with the bid and that the law states if there is <br /> a substantial deviation from the bid specs you cannot <br /> award it to them even if you want to. Malkerson stated <br /> that you have to go with what was submitted at the time <br /> of the bid, and the certification was not submitted. <br /> Councilmember Grabek stated that it would be in the <br /> best interest of the City to reject all bids and to <br /> readvertise to rebid a punch card voting system as the <br /> $1, 296 . 00 difference between the low bid and second <br /> low bid would not exceed the cost of rebidding. <br /> Councilmember Grabek moved, Councilmember Adams <br /> seconded, to reject all bids and to direct staff to <br /> rebid the punch card votingsystem. Motion, Ayes (4 ) , <br /> Nays (1 ) . Councilmember Frahm felt the bid should go <br /> to the second bidder. <br />
