REGULAR MEETING OF TAE ORONO COUNCIL, JANUARY 23, 1984_ PAGE 5 <br /> APPROVAI, OF SUBDIVISION <br /> ORDINANCE - FINAL DRAFT Planning Commission Representative Rovegno stated that <br /> there was discussion at the Planning Commission <br /> meeting on sections in the new subdivision <br /> regulations . Rovegno stated that one section was <br /> public vs. private road. Rovegno stated that they <br /> were suggesting that criteria be set up to determine <br /> whether a road should be public or private. Rovegno <br /> stated there was a suggestion that there should be some <br /> public roads in the rural area. <br /> Mayor Butler stated that you would be opening the gate <br /> to the possibility of public roads in rural areas that <br /> it would create a financial burden on the tax payers . <br /> Butler stated that setting criteria for public and <br /> private would be fine. <br /> Councilmember Adams stated that he liked the way it was <br /> worded originally and that if you put public in there <br /> that you would be waiving the flag of opportunity. <br /> Rovegno stated that he had a problem with the vested <br /> rights section of the subdivision regulations . <br /> Rovegno stated that after the date of this subdivision <br /> code, that you getsome vested rights. Rovegnostated <br /> that the original code stated that you have no vested <br /> rights the next day. Rovegno stated that you have 1 or <br /> 2 years after, which is the minimum. <br /> City Attorney Malkerson stated that the statutes set <br /> up a minimum standard for vested rights . <br /> City Administrator Benson suggested that a special <br /> meeting be held to discuss this public vs . private road <br /> issue. <br /> The City Council set up a special meeting on Thursday, <br /> February 9 , 1984 , at 7 : 00 p.m. to discuss the zoning <br /> code changes, to discuss criteria for public vs . <br /> private roads, to discuss the park fee of Freshwater <br /> Foundation, and to discuss the consideration of the B- <br /> 2 commercial zone for the Planning Commission public <br /> hearing for the rezoning of North Shore Drive Marina on <br /> February 21 , 1984 . <br /> Councilmember Frahm moved, Councilmember Adams <br /> seconded, to table approval of the subdivision <br /> regulations until after the special meeting to be held <br /> on February 9 , 1984 . Motion, Ayes ( 3 ) , Nays ( 0 ) . <br /> FUNDING - STUBBS BAY/ <br /> CRYSTAL BAY AREAS City Engineer Cook presented the report for the funding <br /> of the Stubbs Bay/Crystal Bay area. <br /> Mayor Butler moved, Councilmember Adams seconded , to <br /> direct staff to continue to pursue funding assistance <br /> for these projects . Motion, Ayes ( 3 ) , Nays ( 0 ) . <br />
