REGULAR MEETING OF THE ORONO COUNCIL, AUGUST 22, 1983. <br /> #763 MILTON SEIFERT Stewart Perry and the Seiferts left to discuss <br /> CouncilmemberAdamsproposalandthenreturned with an <br /> answer . <br /> Perry noted that the Seiferts would agree to giving up <br /> two years . <br /> Mayor Butler noted that that would back the street <br /> cabins up to 1988 and move the 1983 cabin to 198h . <br /> Councilmember Adams asked if the three years was <br /> related to the grant expiration . <br /> Perry noted that the grant lasts approximately a year <br /> and a half more but that it would take them some time <br /> more to recover . <br /> Mayor Butler noted the Planning Commission' s <br /> recommendati.on of the majority opinion to deny Mr . <br /> Seifert ' s request and theminorityopinion to grant a 1 <br /> year extension for the lakeshore cabin . Butler <br /> stated that in 198� the City did think they had an <br /> agreement and that they felt assured then that the <br /> agreement would be met in 1983 . What sort of thing is <br /> the City suppose to look for to assure that you won ' t be <br /> back in 198�? <br /> Perry stated that the applicant is willing to waive any <br /> objections that they presently have against the <br /> circumstances in which the agreement was arrived at . <br /> He noted that they would also waive any objections to <br /> � taking of property without compensation . Perry <br /> stated that this time it would not be a coercive <br /> situation. <br /> Mayor Butler asked if the applicant is anticipating <br /> any other innovative forms of use of his mec3ical <br /> talents? <br /> Mr . Seifert stated that he didn ' t think so . <br /> Councilmember Hammerel stated that in 198P� the <br /> applicant was told that the City doesn ' t recognize <br /> economics as a hardship. He stated that they are <br /> right back where they started in 1980 with financial <br /> problems . <br /> Councilmember Frahm stated that the City was in <br /> receipt of surrounding neighbors complaints. He <br /> noted that by granting this extension that the Citymay <br /> be setting a precedent for others . <br /> City Attorney Malkerson clarified some points by <br /> stating that the agreement is valid and an enforceable <br /> one , but that also there would not be an adverse <br /> precedent set if the Council were to modify the <br /> resolution . <br />
