If they <br /> were ever vacated in the future , when you vacate , <br /> youreallydon ` tvacate toanyone specifically, it <br /> goes to the property owner from whence it <br /> original_ly came , you go back to the r_hain of title <br /> 19�1�1 and you probably find that the property that <br /> we refer to as the Gregory property and the <br /> predecessor on title in 189�i may have platted <br /> those blue areas , therefore they go back to <br /> them. It is theoretically possible that the blue <br /> areas were carved out of property that was owned on <br /> the east side , on the Hamm side �nd then in fact , <br /> such a vacation would go over to them even though <br /> it would have to jump over the county road . <br /> Councilman Frahm - Isn ' t that goinq to happen now? <br /> City Attorney Malkerson - It might , but we assume <br /> that isn ' t the case , that the property came from <br /> Gregory , but we wi _ll have to go back to 189G� and <br /> pull the deed and see . <br /> City Planner Olson - Part of this whole deal , <br /> getti.ng away from who is going to do wnat with what <br /> piece of property , was to put in an agreement <br /> together that could be signed by the City, the <br /> County, the Gregorys , the Duffs and the Hamms . It <br /> would be put together in the form of a written <br /> agreement and also ev�ntually a plat drawing that <br /> performedanyvacationthatwasnecessaryto clear <br /> title , any dedication of new right of way, <br /> creation of these outlots whatever to vest <br /> ownership in the correct parties . That was the <br /> form of the agreement . The only problem in what <br /> you are saying is , again getting away from who is <br /> going to do what with the pieces is Hennepin County <br /> has to agree to the Highway right of way before <br /> they sign that plat , before it is able to be <br /> recorded ; so if we don ' t �et into some sort of <br /> agreement and decide how they are going to <br /> maintain their right of way ei.ther on a dedicated <br /> basi_s , or an easement basis that is suggested <br /> here , they simply are going to refuse to sign the <br /> plat and it may not be able to be recorded . <br /> Mr .
