CITY/CONTRACTOR WORK AGREEMENT <br /> THIS AGREEMENT ("AgreemenY') is made this `1 day of s,PNv , 2012, by and <br /> between the City of Orono, a Minnesota Municipal Corporation (the "City") and Mikie's <br /> Landscaping (the "Contractor"). <br /> In consideration of the mutual covenants and promises contained in this Agreement, the City and <br /> the Contractor agree as follows: <br /> 1. General Conditions. Contractor shall perform the work described by this Agreement <br /> and the Specifications as set forth in Exhibit A attached hereto (the "Work"); and any written <br /> Change Orders executed by the City and the Contractor. <br /> 2. Work to be Comnleted. Contractor shall provide all labor and materials necessary to <br /> complete the Work for the demolition of buildings (the "Demolition") and the proper removal <br /> and disposal of all demolition material,junk, refuse and debris from 3572 Livingston Avenue, <br /> Orono, Minnesota(the "Property"). <br /> 3. Commencement and Completion of Work. To the extent necessary, the Work shall <br /> commence only after removal of all regulated waste is performed by the regulated waste <br /> contractor and the Contractor is provided by the City with a written"Notice to Proceed". <br /> 4. Disposal of All Demolition Material. Contractor shall comply with all applicable laws, <br /> rules and regulations regarding the disposal of all demolition material,junk, refuse and debris <br /> from the Property. <br /> 5. Pavment. The Work including all labor, materials, and equipment needed to accomplish <br /> the same, shall be completed by the Contractor for the sum of Eight Thousand Eight Hundred <br /> Thirty and no/100ths Dollars ($8,830.00) (the "Contract Price")to be paid to the Contractor in <br /> one installment upon completion of the Work to the satisfaction of the City. The Contractor <br /> agrees to furnish the City with all Mechanics Lien Waivers and evidence of the proper disposal <br /> of all demolition material,junk, refuse and debris deemed necessary by the City, prior to full <br /> payment of the Contract Price. The Contract Price shall constitute the sole compensation <br /> payable to the Contractor for completion of the Work. <br /> 6. Storage and Protection. Contractor shall be responsible for the storage and protection of <br /> all equipment and materials to be supplied under the terms of this Agreement until the Work is <br /> complete and the City has accepted the Work. <br /> 7. Clean-up. Contractor shall maintain an orderly and clean work site, and shall daily <br /> remove and properly dispose of all waste, and debris resulting from performance under this <br /> Agreement. <br /> 1 <br /> 161939 <br />
