5. Since the owner, owner of record and lienholder of record have not complied with the <br /> City of Orono's Order, they seek an Order from this Court for enforcement thereof. <br /> CONCLUSIONS OF LAW <br /> l. Pursuant to Minn. Stat. § 463.19 this Court, upon the presentation of such evidence as <br /> it may require, has the authority to affirm or modify the Order for the Correction of Hazardous <br /> Conditions and Abatement of Public Nuisances and enter judgment accordingly, fixing a time <br /> after which the governing body may proceed with the enforcement of the Order. The Court <br /> Administrator shall cause a copy of the judgment to be mailed forthwith to persons upon whom <br /> the original Order was served. <br /> 2. Rule 602 of the Housing Court Rules for Hennepin County authorizes the Housing <br /> Court Referee to preside ever proceedings involving health, safety, h��asing, b��ilding and fir;, <br /> prevention or housing codes. <br /> ORDER <br /> 1. The motion of the City of Orono for Correction of Hazardous Conditions and the <br /> Abatement of Public Nuisances existing at 3572 Livingston Avenue, Orono, Minnesota, is <br /> hereby granted. <br /> 2. The City of Orono or its agents are authorized to enter the property to correct the <br /> condition of the property so it is no longer hazardous and complies with all applicable building <br /> codes and ordinances. This includes the removal of the house, all accessory structures, vehicles <br /> and miscellaneous debris located on the property. <br /> 3. The City may thereafter seek an assessment on the property of costs of the repairs, <br /> razing, correction or removal, including attorney's fees and costs in accordance with Minn. Stat. <br /> §§ 463.21 an 463.22. <br /> 4. The City of Orono shall make a good faith effort to have this Order served on the <br /> above name owners of the property. <br /> 5. This Order shall be binding on all owners and lienholders of record as well as their <br /> successors in interest, if any. <br /> 6. SERVICE OF ORDER: The Clerk of Court shall either give to the parties or mail to <br /> the parties by first class mail a copy of this Order.
