REGULAR MEETING OF THE ORONO COUNCIL, MAY 11 , 1981 Page 3 Mr. Timothy Mehner and Mr . Hubbard were present CRYSTAL BAY SERVICE to discuss a conditional use permit and a 1981 3398 North Shore Drive marina license for the Union 76 Service Station #608 at 3398 North Shore Drive . Timothy Mehner Discussion included the dock on Crystal Bay to be used for fueling and minor service of boats, but not to exceed three slips--two for service to be used only during the daytime and one to be used for over-night docking for the owner 's boat only. It was noted that the service station and the fueling dock on Crystal Bay were a needed service to the residents on land and in the water. Hurr moved, Hannah seconded, to direct staff to draft two resolutions : 1) conditional use permit for service station in a B-2 zoning district, 2) to approve a 1981 commercial dock license for proposed fuel dock and boat towing service on Crystal Bay. Both should reflect the need for a variance for lack of the one year operation and that the dock be constructed to meet all setback requirements of the Lake Minnetonka Conservation District and the City of Orono codes and approval of the Marina Committee. Motion, Ayes (5) - Nays (0 ) . Mr . John Vogt was present to discuss with the City SAILORS WORLD Council. his 1981 Marina License for Sailors World, 1981 Marina License 1955 Shoreline Drive . This item was tabled until the next meeting. Mr. Larry Hork and his attorney, Bruce Douglas, NORTH SHORE DRIVE were present to discuss the 1980 & 1981 Marina MARINA Licenses for the North Shore Drive Marina . Bruce Douglas stated that the real issue is the dock length along the northwest side of the property. Douglas stated that, in 1977 , the docks were damaged by ice and that the marina then applied for a building permit. Douglas alleged that the dock originally was at right angles to the main dock and was beyond the 200 foot limitation� but during the reconstruction in 1977, the winqs of the dock were angled back to be within 200 feet. The 1977 plan that was submitted then and later corrected to show a 929 .4 contour, which is made available to the City tonight, shows that the wings of the docks were intended to be constructed within 200 feet of the lakeshore . Douglas stated that before and after the docks were reconstructed, that the plan and the docks were reviewed and approved by Hank Muhich and Alan Olson of the City of Orono. Mr. Hork stated that Muhich inspected and measured the docks and said that they were all right and to go ahead with the construction. Douglas stated that a great amount of erosion had taken place in the last couple of years and as a consequence of this, the docks are now further from the shoreline than they were in 1977. (Cantinued)
