These new updated percentages shall be in effect until such time as a new percent usage review is requested, calculated, and approved. Page 10 - Change Section 16 - last sentence to read, "except Long Lake will not allow any hookups that flow into Pipe D in excess of 70 units as outlined in each city ' s percen�� usage contribution without the written consent of Medina and Orono" . Page 11 - Section 19-Termination. , Subdivision 1. This agreement may be terminated by any party if any other party fails or refuses to comply with the final order, after expiration of all appeals, of the arbitration panel or Court of competent jurisdiction. Subdivision 2 . Termination of this agreement, in lieu of a breach or other arbitrable agreement, shall be arbitrable and shall occur only after a finding that there has been such a substantial change in the law of the facts existing upon the effective date hereof, that the agreement is impossible to perform by one or both parties. Subdivision 3 . In the event this agreement is terminated, the ownership of the pipes, manholes, lift stations, and metering devices shall be as follows: a) The Medina lift station, metering device and Pipe A shall belong to Medina. b) Pipe B and Pipe D shall belong to Orono. Orono shall reimburse Medina for their share of the construction cost of Pipe B and Pipe D and Orono shall have the right to stop the flow of sewage from Medina into Pipe B and from Medina and Long Lake into Pipe D.
