As you know, <br /> the C�ty is retaining approximately $42, 000 . 00 in liquidated <br /> ' damages because of the contractor ' s failure to complete the <br /> project in a timely manner. <br /> I anticipate that at the August 11, 1980 Council meeting, <br /> the City Council will decide, based upon recommendations by <br /> City Staff, how it wishes to deal with the final payment. <br /> If you wish to submit any arguments ahead of time in writing, <br /> whether they be legal, factual or equitable, as to why the <br /> City should not continue to withhold the $42, 000. 00 in <br /> liquidated damages, please submit such arguments to me by <br /> August 6, 1980. It is my present recommendation to the City <br /> Council that based upon the facts and the law, the City has <br /> the right to retain as liquidated damages the $42, 000. 00. <br /> In the spirit of cooperation I am offering you and your <br /> client this opportunity to persuade the City Staff and the <br /> City Council to take a different course of action. <br />
