Is it not true that the area is zoned <br /> residential? <br /> James Rivers: Yes , but the uses have been commercial. <br /> Lou Oberhauser: Historically, the property has <br /> been used for marina uses. Mr. Rivers does not want <br /> to expand the operation but we do want to clear the � <br /> uses of this property for peace of mind. We feel <br /> proper deed restrictions can satisfy us and control <br /> the uses of the property. rdo one is benefiting if <br /> the property is a no man' s land. <br /> Mayor Van Nest asked if the public had any comments : <br /> There were none. <br /> Councilmember Paurus : It should be made clear that <br /> in any new rezoned area, the dock use area would <br /> be limited to dock lengths of 100 feet. <br /> Mayor Van Nest: Tanager Lake is a very sensitive <br /> Bay receiving pollutants from the Long Lake Creek <br /> and has to be limited to its uses. I really have <br /> problems with dual uses of a piece of property. <br /> We have to determine , by boundaries, what will be <br /> used for residential, and what will be used for <br /> commercial. The shoreline has to be restricted <br /> to its future uses; . again, we cannot guarantee <br /> vested rights to a lake. <br /> As I see it, we have to consider: <br /> 1. Not more than 40 boats should be stored at <br /> Tanager Bay <br /> 2. They should be stored where they are now <br /> 3. Dock length has to conform to LMCD' s regulations <br /> 4. The City has requested before and should insist <br /> upon a certified survey showing existing docks <br /> 5. Orono' s actions concerning Victoria Grain is <br /> a realistic example of providing open space <br /> easements <br /> (Continued) <br />
