Frank <br /> United Pacific Insurance Company <br /> 12 South Sixth Street <br /> Minneapolis, Minnesota 55402 <br /> RE: United Pacific Insurance Company Bond <br /> Number U977706 , <br /> Buffalo Bituminous , Inc. - <br /> City of Orono, Minnesota for street grading <br /> and surfacing on ring route, Orono, Minnesota <br /> Dear Mr. Frank: <br /> As you know, the City of Orono entered into a contract with <br /> Buffalo Bituminous , Inc. in June, 1979 , which contract required <br /> that the contractor complete . the project by November 15 , 1979 . <br /> As of November 15, 1979 , the contractor had not completed the <br /> project pursuant to the contract documents. <br /> United Pacific Insurance Company had issued the performance <br /> bond pursuant to the contract for this project. <br /> Previously your company sent a form letter to the city asking <br /> whether or not the project had been completed and the city <br /> responded that the contractor had failed to complete the <br /> project as provided in the contract. <br /> Prior to November 15 , 1979 , the contractor did not request <br /> any extension in the contract and no request was made in fact <br /> until November 28 , 1979 . <br /> It is now anticipated that the contractor will not be able <br /> to complete the project until June 30 , 1980 .
