� REG�LAR MEETING OF THE ORONO COUNCIL, JANUARY 30 , 1980 Page 12 A memo to the City Council from Dick Benson, City RING ROUTE CONSTRUCTION Administrator, concerning the ring route construction, dated January 24 , 1980 , states : Action was taken at our last Council meeting to pay Buffalo Bituminous Payment #5 in the amount of $36 ,550. 95 , subject to: l. Notifying bonding company of Orono' s concerns relating to failure to complete project on time and possible lack of sufficient funds to protect City' s financial exposure plus cause for liquidated damages. 2. Determine schedule of completion in 1980 3. Process necessary change orders 4. Initiate agreement to maintain street The City has had a total lack of cooperation from the contractor in responding to our letters and telephone calls, which cannot be tolerated. We cannot afford to allow the contractor to dictate to us how and when,if ever, the project will be completed. I called a meeting for 10: 00 A. M. , January 22 , 1980 and met with the contractor, his attorney, Bruce Malkerson and Glenn Cook, our engineer. Attached are notes on our meeting, a copy of our letter to the bonding company and a reply from Buffalo Bituminous. When we are satisfied that the bonding company and Buffalo Bituminous are coordinating their efforts to satisfy the owner, which is Orono, we will release the payment. January 22 , 1980 - 10 : 00 A.
