. , Page 18 <br /> January 11, 1980 <br /> City Administrato� <br /> City of Orono, Mii. .��sota <br /> Dear Sirs; <br /> In regards to letter of J�uary 9, 1980, project was let on April 27, <br /> 1979. We did not get a notice to proceed until June 19, 1979. No <br /> additional time was alloted to complete project. We then had to contract <br /> with Elk River Concrete Co. to construct concrete box culverts, contract <br /> with grading contractor who had some delay getting started as to prior <br /> commitments, also same with underground contractor. <br /> The box culverts were not completed and delivered until September of 1979 <br /> due to delay in awa:-�? of contract. We also had a change order to construct <br /> a retaining wall as an extra item to the contract which we were not able <br /> to get a subcontractor to even start this project in 1979. Buffalo Bituminous <br /> d.id get the bulk of the work completed and road opened for use of City in <br /> November, 1979. <br /> Buffalo Bituminous will not accept any liquidated damages on this project� <br /> and you will also note that under the law we are required to be paid <br /> month.�y, and if not paid on es�imate we are entitled to interest on amounts <br /> not paid. We fully intend to complete project by Ju�y 1� 1980, and do not <br /> see where there is any breach of contract.
