During the <br /> course of the construction, we frequently reviewed the status of the project <br /> with you or a representative of your company to stress the importance of timely <br /> completion. You have failed to meet the agreed upon deadline. The City Council <br /> is concerned about the future completion of the remaining work on the project <br /> because of the delays encountered to this date. The safety of the driving pub- <br /> lic on the roadway, lack of vegetation on the slopes, and maintenance of the <br /> roadway through the completion of the project are additional concerns. The City <br /> therefore feels that liquidated damages as provided for in the contract should <br /> be assessed on the project as indicated in our November 26, 1979 letter. <br /> The contract starting date on the project was indicated as on or before June 15, <br /> 1979 with authorization to start work being given on June 19, 1979. Completion <br /> of the project by November 15, 1979 would not have been a problem had your grad- <br /> ing contractor remained on the project and the other project operations been <br /> better coordinated by you. The City of Orono did not receive a request for time <br /> extension during the course of the project and have no plans to grant the ex- <br /> tension of time based on your November 28, 1979 letter. <br /> The concerns of the City is that in the event it is necessary to bring in another <br /> contractor to complete the project adequate money is not presently being with- <br /> held. Liquidated damages from November 15, 1979 through June 30, 1980 would <br /> amount to $45,600. If the completion extends beyond this time damages would be <br /> even greater. The estimated work remaining on the project is $230,000+ and in <br /> the event this work must be rebid, anticipated inflation of 15 percent <br /> ($34,500) would have to be added to the project cost. Moreover, in the event <br /> you elected to leave the job, any new company would undoubtedly charge a <br /> premium to finish the reduced project which could amount to as much as $10,000. <br /> Page 1. <br />
