The building was inspected and <br /> found to be in excellent condition. The <br /> proposed chanc�e will not effect the hard- <br /> cover calculation. The deck will measure <br /> 12 ' X 24' . <br /> . The structure is located within the 75 ' lake- <br /> shore setback and is recognized as a legal <br /> non-con�orming use. Ordinance prohibits <br /> the extension or intensification of_ non- <br /> con.f_orr.ling uses. <br /> 31. 108 Plorrial riaintenance of a huilding <br /> or other structure containing or related <br /> to a lawful non-conforming use is �erriitted, <br /> including necessary non-structural repairs <br /> and incidental alterations which do not <br /> extend or intensify the non-conforminc� use. <br /> (Ord. 172 , 12/19/74, effective 1/1/75) . <br /> Ordinance states (32. 210) that the Zoning <br /> Adr.iinistrator may review this type of <br /> request by the issuance of a CertificatP <br /> o� Occupanc�� at the time the buildinc� nermit <br /> is issued. � Staff decided the sensitive <br /> nature of this request required Council' s <br /> direction and review. The conditional use <br /> permit �vas deterr..iined to be the riost aPnropriate <br /> type of application. <br /> Please review the Planning Comr.iission r�inutes <br /> of August 27, 1979 (Exhihit l0A) and Sent- <br /> er.iber 10, 1979 (Exhibit lOB) for backc�round <br /> discussion and their recommendation. <br /> IV. #531 - Variance <br /> The Van Tassels now request a variance to <br /> construct a deck 10' X 16 ' on the north side <br /> of the lot. The hardships claims stated by <br /> the az�plicant are the same used in the conditional <br /> use permit application requesting a deck roof <br /> for the boat house. Those hardshins to the <br /> land are the steep slope and no ad�acent land <br /> available. The variance is revie��ed for ��ou in <br /> the enclosed exhibit sheets. <br /> (Continued) <br />
