Sec,13,04 RIGHTS OF SUBJECTS OF DATA
<br /> Subd. 1. Type of data. The righ[s of individual on whom the data is stored or to be stored shall be as set forth in this section.
<br /> Subd.2. Information required to be given individual. An individual asked to supply private or confidential data conceming hin�self shall be
<br /> informed of: (a)the purpose and intended use of the requesced data within the collecting state agency,political subdivision,or statewide syscem;(b)
<br /> whether he may refitse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusino to supply
<br /> private or confidzntial daca;and(d)the identity of other persons or entities authorized by state or federal law to receive the daia.This requi�ement shall
<br /> not apply when an individual is asked to supp(y investigative da[a,pursuant to section 13.32,subdivision 5,to a law enforcement officer,

<br /> Subd.3. Access[o data by individual. Upon reques[to a responsible authority,an individuzl shall be informed whether he is the subject of
<br /> stored data on individuals,.and whether it is classified as public,private or confidential, Upon his fur[her request,an individua(who is the subject oi
<br /> � stored private or public data on individuals shall be shown the data witllout any charge to him and,if he desires,shall be informed of[he conten[and
<br /> meaning of that data. After an individua]has been shown the pnvate data and informed of its meaning,the data need not be disclosed to him for sis
<br /> months thereafter unless a dispute or action pursuant co this section is pending or addicional data on the individua!has been collected or created. The
<br /> responsible auchority shal!provide copies of the private or pubGc data upon request by the individual subject of the d2ta. The responsible authority
<br /> may require the requesting person to pay the actval coscs of makiag,certirying,and compiling the copies.
<br /> The responsible authonty shail comply immediately,ifpossi6le,wifh any request made pursuant to this subdivision,OC Wl:IIIR fi`.'c"�3V5 OF
<br /> the date of the request,e�cluding Sa[urdays,5undays and legal holidays,if immediate compliance is not possible. If he cannot comp!y with the request

<br /> Sundays and legal holidays.
<br /> Subd.4. Procedurewhen daca is not accurate or comp!ete. An individua!may contest the accuracy or comple[eness ofpublic orprivate da[a
<br /> conceming himsel£ To exercise this right,an individual shall notify in wiiting the responsible authonty descnbing the nature of the disagreement.The
<br /> responsible au[honry shall within 30 days either: (a)con•ect the data found to be inaccurate or incomplete and at[empt to notify past recipients o`
<br /> inaccuratc or incomplete data,including recipients named by the individual;or(b)notify the individual!hat he believes the datz to be correct. Da[a in
<br /> dispute shall be disclosed only if the individual's siatement of disagceeme�[is includzd with the disclosed data.
<br /> The determinat;on of the responsible authority may be appealed pursuanc to thz provisions of the administrative procedure act relacing to
<br /> contested cases.
