Since you (Elizabeth and William <br /> Kallberg) created this condition and failed to resolve this to <br /> the city' s satisfaction and then sold to the buyers without <br /> disclosure, you are now responsible for the following: <br /> Cost of the survey and any fees the city may require <br /> to grant the variance, and any expenses for permits, ' <br /> plus any labor and materials that may be needed to <br /> reinforce the footings and/or tear down and rebuild <br /> the deck to comply with city code. <br /> At the time of purchase of subject property, the buyers and <br /> their agent were not informed of the fact that the deck was <br /> not in compliance with city codes and that a permit was never <br /> taken out when the deck was constructed. <br /> As of October 19, 1992 copies of all correspondence between the <br /> Kallberg' s and the city regarding this issue have been provided <br /> to the current owners.
