I hadn't anticipated, however, that you would replace the deck with fill <br /> and a retaining wall which, of course, is still in violation of the hardcover and setback <br /> ordinances. If you would have informed us of your intentions, we would have told you it was <br /> not allowed. I am sorry if there was a misunderstanding. I assumed you understood that there <br /> is no hardcover or any work allowed in the 0-75' setback, which is why the deck was required <br /> to be removed. <br /> You have two options to remedy the situation. Either remove the work and return the grade to <br /> original condition or apply to Ciry Council for a Conditional Use Permit and Variance to see if <br /> they would allow you to keep it.
