T4otion, <br /> Ayes (5) - Nays (0) . <br /> Alan Olson, City Planner, entered into the record VACATION - LAKE <br /> the request of Charles Carl, 3685 North Shore ACCESS <br /> Drive, for a lake access vacation c�ated 3685 North Shore Dr. <br /> October 23, 1979 , which states: #498 <br /> Charles Carl <br /> Pir. Carl has asked the City to consider vacatinq <br /> a portion of a lakeshore access easement o.f 33' . <br /> The access is used basicallv in the winter months <br /> by snowmobilers and fishermen seekinq lake access <br /> to their fish houses. <br /> The anplicant asks that the portion that is unused <br /> and which he maintains be vacated. "_'he propert_y <br /> o�aner on the southern edge of the access, Dr. Sullwold, <br /> approves of the vacation. There were no comments <br /> fror.i the audience except for Dr. Sullwold' s apnroval <br /> at the public hearing. <br /> Unfortunately, the enclosed survey was not seen b_y <br /> the PlanniMg Commission when they made their recom- <br /> r.tendation on September 10 , 1979. The�� were under <br /> the impression that 40' remained o.f a 55' easement. <br /> Staff (Public Works Director and Zoning �dministrat�r) <br /> made a second ins�ection of the access in order to <br /> confirm the 18 ' pro�osed easement designated on <br /> survey. �Ve measured 31' ; the difference in findinc�s <br /> is caused by the erosion of the lake along the lake- , <br /> side of the access. � <br /> ��Te reviewed all this with the Planning Cormmission at <br /> their October 15 , 1979 meeting and the�j hold to <br /> their original recommendation as follows: <br /> Planning Commission recommended approval of the vacation <br /> rec�uest as it does not affect �uhlic access to the <br /> laY.e and served the good of the public by puttinq <br /> the property back on the tax roles, contingent on the <br /> applicant submitting a description of_ the entire <br /> easement. <br /> Council Pieeting - October 30 , 1979 <br /> 11r. Charles R. Carl was present to discuss his application. <br /> Bruce 14alkerson, City Attorney: The City of_ Orono should <br /> not �iacate any lake access which was determined by a <br /> recent Supreme Court decision. <br /> (Continued) <br />
