The park fee should not be charc�ed as there is <br /> an existing dwelling on both lots. <br /> 2. Each lot has separate, actually existinc� access. <br /> Any mutual easement for reciprocal use should <br /> be a private matter of no concern to the City. <br /> 3. Pir. Lauer' s concern for the easement across the <br /> north part of the �roperty is natural. The <br /> easement is developed as a gravel drive and <br /> though poorly maintained, is a secondarv access <br /> to the Lauer property. I would suqgest rec7uiring <br /> this easement to be platted as an outlot so the <br /> access will be visible on the plat and will be <br /> less likely to be encroached upon in the future. <br /> The City could ic�nore the easerlent and assume <br /> that it will carry through with validity, but <br /> the outlot method will assure the intent of the <br /> easement in providing access to the otherwise <br /> , land-locked Lauer lot. <br /> 4. The encroaching shed is of minimal value and <br /> easily moved and/or removed. <br /> 5. The most serious' c�uestion was apparently not <br /> discussed by the Planning Commission. The <br /> neighboring house at 1480 Bohns Point Road is <br /> shown as encroaching on this propert_y. �ae have <br /> a survey on file showing a 50 ' setback for the <br /> original construction in 1962, plus other nermits , <br /> for a 24 ' X 24 ' addition and conversions without ' . <br /> surveys, but nothing to indicate such an encroach- <br /> ment. <br /> The Scherber' s surveyor should recheck and confirm <br /> or clearup any encroachment. <br /> If there is encroachment, I suqgest that at least <br /> 10' of side yard be platted and sold to the <br /> nei�hbor to resolve this probleri. Such a sale <br /> would not adversely affect this x�roper_tv. <br /> 6. Bohns Point Road should be platted and dedicated <br /> 33' from centerline. <br /> Council Meeting - October 30 , 1979 <br /> David Carlson, representing P�Ir.
