Motion,
Ayes (4) - Nays (0) .
Butler moved, ilassengale seconded, to apnrove SEVF;R CONNECTION REPORT*
the status report of sewer connections as of
September 25, 1979 , prepared by P'lichael Gaffron,
Septic System Inspector. ".tin, Aves (4) - Nays (0) .
Alan Olson, City Planner, entered into the record COPdDITIONAL USE PER'IIT
the request of_ Tarren Ortenhlad, 3870 Shoreline 3870 Shoreline Drive j
Drive, for a conditional use permit dated 452 j
October 4 , 1979, which states: 7arren Ortenblad '
This proposal was approved by Council on July 10 ,
1979, subject to resolution of access nroblems
with Hennepin County and to drainage-flood plain
plan review by the City Engineer, including
provision of a flowage easement to the Citv.
This report is to advise Council that we have
finally received an official reply frori Hennepin
County regarding the access. As vou can see by
Mr. Iiustad' s October 1, 1979 letter, Hennenin
County would deny use of their drivewa_y unless
the City would accept dedication f it as a '
public street.
This option appears irrational as the actual
function of the driveway would not change, it
connects with no City street, and Hennenin
County even offers to continue maintenance. If
they are so concerned about liability, whv not
dedicate the driveway to themselves as part of
County Road 15 as the County is the r.maor user
and continues to invite public tra.ffic to ue the
shops as overlow arking.
In any event, I would propose to replv to *Zr.
Iiustad that the City will not accept dedication of
the driveway as being contrary to Cit olicy or
to any logical Cit purpose.
Because either access was aPproved, there is no
need for any Council action on this natter, unless
vou wish to direct me other than as above.
